AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
A CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF A
BUILDING TO BE USED AS A RELIGIOUS EDUCATIONAL CLASSROOM FOR
HIGH SCHOOL STUDENTS IN AN R-4 (MULTIPLE FAMILY RESIDENTIAL)
ZONE, WITHIN THE CITY OF AUBURN, WASHINGTON AND REPEALING
ORDINANCE NO. 4551 PASSED MARCH 16, 1992.
WHEREAS, Application No. CUP0006-92 dated September 2,
1992, together with site plans therefore, has been submitted
to the city of Auburn, Washington, by The Church of Jesus
Christ of Latter-Day Saints - Northwest Area requesting a
Conditional Use Permit to allow the the construction of a
building to be used as a seminary classroom for high school
students on property zoned R-4 (Multiple Family) within the
City of Auburn, Washington, hereinafter described in Section 2
of the ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and pUblic hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on August 18, 1992, at the
conclusion of which the Hearing Examiner recommended the
approval of the issuance of a Conditional Use Permit to allow
construction of a building to be used as a religious
educational classroom for high school students to be located
at 331 4th Street N.E. in an R-4 (Multiple Family Residential

District) zone based upon the following Findings of Fact and
Conclusions, to-wit:
FINDINGS OF FACT
1. The applicant, The Church of Jesus Christ of Latter Day
saints, Northwest Area, applies for a conditional use
permit to allow the construction of a 3,020 square foot
building to be used for a religious educational classroom
~ for high school students which attend the adjacent Auburn
High School.
2. The Hearing Examiner and the City council previously
approved a similar conditional use permit for the same
project in March of 1992, although at that time the
proposed building size was 1,800 square feet. The
applicant now proposes to build a 3,020 square foot
building because a determination has been made that the
enrollment and class size was under-estimated. The
enrollment is now estimated at 130 students and there may
be one or two classes per day which would have up to 50
students. The building is similar in construction to
what was previously proposed as it will contain one story
in a maximum height of 20.75 feet. The building will be
constructed of brick and wood and will have a look
similar to that of a single family residential home.
3. The subject property is located at 331 - 4th Street N.E.
and is 11,812 square feet in size. The subject property
is currently zoned R-4, multiple family. This zoning
allows for religious institutions subject to the issuance
of a conditional use permit.
4. As previously indicated, the proposal is located adjacent
to Auburn High School, only about 800 feet from the
campus. It is anticipated that students who will attend
the classes at this facility will arrive on foot from the
high school.

6. The applicant indicates that the facility will contain
one classroom staffed by one teacher who will conduct
either five or six classes per day. Most of the classes
will be small, only 10-20 students. However, one or two
classes may be as large as 50 students and hence the need
for a larger facility than originally anticipated.

persons living or working in area than would any use
generally permitted in the district. The proposal is
more in line with the neighborhood in terms of its size,
construction, and amenities than would multiple family
uses which would be permitted outright on the site.
3. The proposal is in accord with the goals, policies and
objectives of the Comprehensive Plan and also complies
with the requirements of the Zoning Ordinance.
4. The building will be constructed and maintained so as to
be harmonious and appropriate in design, character and
appearance with existing residential character of the
general facility.
5. There is no evidence that the proposal will adversely
effect the public infrastructure.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
section 1.
The above cited Hearing Examiner's Findings
of Fact and Conclusions, are herewith incorporated in this
Ordinance.
section 2.
A Conditional Use Permit is hereby approved
to allow construction of a building to be used as a religious
educational classroom for high school students to be located
at 331 4th Street N.E. in an R-4 (Multiple Family Residential
District) zone, situate in the City of Auburn, County of King,
State of Washington, and is legally described as follows:
Lots 5 and 6 and the east 12.5 feet of Lot
7, Block A, Arthur C. Ballard's Condict
Addition to Auburn, according to the plat
thereof, recorded in Volume 19 of Plats,
page(s) 88, in King County, Washington,
except the south 5 feet thereof conveyed
to the City of Auburn for street purposes
by deeds recorded under recording number
6702925 and 6702926.

section 3. Ordinance No. 4551 passed March 16, 1992, is
hereby repealed in its entirety.
section ... Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.
section 5. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.

This Ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as provided by law.
