HomeMy WebLinkAbout4661 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18, 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 6 6 i AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF ROEGNER PARK ON PROPERTY LOCATED ON THE SOUTH SIDE OF STUCK RIVER AND EAST OF "A" STREET BRIDGE AND MILL POND PARK LOCATED SOUTH OF ORAVETZ ROAD AND EAST OF MILL POND DRIVE, WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM UNCLASSIFIED, R-4 (MULTI- FAMILY) C-1 (LIGHT COMMERCIAL) TO P-1 (PUBLIC USE DISTRICT) AND COMPREHENSIVE PLAN MAP AMENDMENT FROM MULTI-FAMILY AND GENERAL COMMERCIAL TO PUBLIC AND QUASI PUBLIC. WHEREAS, Application No. REZ0001-94 and MIS0004-94 has been submitted to the Council of the City of Auburn, Washington, by the City of Auburn, requesting the rezone and Comprehensive Plan Map amendment of the real property hereinafter described in Section 2 of the Ordinance; and, WHEREAS, said request above referred to, was referred to the Planning Commission for study and public hearing thereon; and WHEREAS, the Planning Commission, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on February 28, 1994, at the conclusion of which the Planning Commission recommended to the Auburn City Council that the application be approved; and WHEREAS, March 7, 1994, the City Council at its regular meeting held approved the rezone and Comprehensive Plan Map Ordinance No. 4661 March 30, 1994 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 amendment of said property based upon the following Findings of Fact and Conclusions, to-wit: FINDINGS OF FACT The city of Auburn is proposing to establish the P-I, Public Use, zone upon Roegner Park and Mill Pond Park. A Comprehensive Plan map amendment is also being proposed to designate the park areas as public and quasi-public uses. Roegner Park is currently zoned unclassified. The uses allowed in the unclassified zone are those listed in the R-i, Single Family, zone. The R-1 zone at Section 18.12.020(D) does allow municipal parks as a permitted use. Most of the Mill Pond Park site is zoned R-4, Multi- Family. The R-4 zone at Section 18.18.020(F) allows municipal parks as a permitted use. A small portion of the Mill Pond site is zoned C-i, Light Commercial. The C-1 zone is silent on park uses. This portion is, however, not yet developed as park uses. Mill Pond Park is, however, planned to be expanded to accommodate not only additional park uses, but a storm drainage facility as well. While the existing zoning allows for the existing park uses, it would be more practical to have the park property zoned the same as the adjacent high school site. Having the park property the same zoning as the school also allows a lesser setback requirement between the school property and the park. If the school property is zoned P-l, the Zoning Code requires a 30 foot setback from the property line of any residential zoned parcel. If the two properties are both zoned P-l, then the setback could be as little as five feet. Ordinance No. 4661 March 30, 1994 Page 2 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1 2 3 4 5 6 CONCLUSION OF LAW It has been concluded that the rezone and Comprehensive Plan map amendment may be approved in that it would more accurately reflect the park use and would be more compatible with the zoning on the high school site. For each of the above referenced reasons, the recommendation of the Planning Commission to the Auburn City Council on the requested rezone and Comprehensive Plan Map amendment is approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Planning Commission's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. Section 2. Roegner Park located on the south side of Stuck River and east of the "A" Street Bridge and Mill Pond Park located south of Oravetz Road and east of Mill Pond Drive, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from Unclassified, R-4 (Multi-Family) C-1 (Light Commercial) to P-1 (Public Use District) togetherwith a Comprehensive Plan Map amendment from Multi-Family and General Commercial to Public and Quasi Public and legally described as follows:: Ordinance No. 4661 March 30, 1994 Page 3 1 2 3 4 5 6 7 8 9 10 ll 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 PARCEL 1: That parcel of property, deeded to the City of Auburn by Puget Sound Power & Light, as legally described in a Deed of Dedication dated October 27, 1991, with the recording numbers of 9201100939 and 920110940. PARCEL 2: That parcel of property, deeded to the City of Auburn the Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter-Day Saints, as legally described in a Special Warranty Deed da'ted March 8, 1989, with the recording number of 8906290986. PARCEL 3: That parcel of property, deeded to 'the City of Auburn the Corporation of -the Presiding Bishop of the Church of Jesus Christ of Latter-Day Saints, as legally described in a Special Warranty Deed dated March 8, 1989, with the recording number of 8906290993. Section 3. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor, Division of Records and Elections. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation.
