ORDINANCE NO. 4 6 8
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, REPEALING AUBURN CITY CODE CHAPTER 10.14 ENTITLED
"DRIVING OR CONTROL OF A MOTOR VEHICLE WHILE UNDER THE
INFLUENCE" TO COMPLY WITH STATE LAW.
WHEREAS, the state legislature has set forth penalties
for alcohol concentration of at least 0.10; and
WHEREAS, the RCW 35A.11.020 which becomes effective July
1, 1994 requires that punishment for any criminal ordinance
shall be the same as the punishment provided in state law for
the same crime.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
gectlon 1. PURPOBE. The purpose of this Ordinance is
to repeal Auburn City Code Chapter 10.14 entitled "Driving or
Control of a Motor Vehicle While Under the Influence" to
comply with state law.
geotion Z. Auburn City Code Chapter 10.14 entitled
"Driving or Control of a Motor Vehicle While Under the
Influence", passed by Ordinance No. 4656 (1993) is herewith
repealed in its entirely.

litigation and does not operate as an abatement or bar to any
action or proceeding pending under or by virtue of the repeal
thereof.
