WHEREAS, the Chapter 275, Laws of 1994, known as the "1994 Omnibus Drunk Driving Act" shall take effect July 1, 1994; and WHEREAS, certain provisions of the 1994 (~nibus Drunk Driving Act have not yet been adopted in the WaShington Model Traffic Ordinance which will become effective on July 1, 1994; and WHEREAS, RCW ·6.20.730 has not yet been adopted in the Washington Model Traffic Ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Seotion 1. PURPOSE. The purpose of this Ordinance is as follows: To add a new Chapter 10.05 to the Auburn City Code entitled "Specified Sections of the 1994 Omnibus [Drunk Driving Act and RCW 46.20.730 Adopted by Reference" in order to adopt sections of the act and RCW 46.20.730 which are not included in the Model Traffic Ordinance contained in the Washington Ordinance No. 4682 June 14, 1994 Page 1 CITY ATTORNEY City of Auburn 25 U. #ain (206) 931-3030 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Administrative Code, Ch. 308-330 Auburn City Code Chapter 10.04. ~eot~on 2. NEW AUBURN and adopted by reference in CITY CODE CKAPTER 10 · 05 ENTITLED "SPECIFIED SECTIONS OF THE 1994 OMNIBUS DRUNK DRIVING ACT AND RCW 46.20.730 ADOPTED BY REFERENCE. Chapter 10.05 entitled "Specified Sections of the 1994 Omnibus Drunk Driving Act and RCW 46.20.730 Adopted by Reference" is hereby added as set forth in Exhibit "A" attached hereto and incorporated herein by this reference. Section 3. constitutionality or Invalidity. If any section, subsection, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed, adopted and approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. 8eotion 5. Specified sections of Chapter 275, Laws of :[994 known as the "1994 Omnibus Drunk Driving Act" as set forth in this chapter and RCW 46.20.730 are hereby adopted by reference, including all future amendments or additions thereto, and under the provisions of RCW 35A.12.140, the chapter codified in this section shall be published as required by law, but the specified sections of Chapter 275, Laws of 1994 and RCW 46.20.730 adopted by reference need not be published but shall be authenticated and recorded with the Auburn city clerk, and not less than one copy of the specified sections and RCW 46.20.730 in the form in which they were adopted shall Ordinance No. 4682 Exhibit "A" June 14, 1994 Page 4 CITY ATTORNEY City of Auburn 25 W.
