WASHINGTON, ~ENDING O~IN~CE NO. 4627 BY R~ISING CONDITION 3 NO. 8.K.3 T~T REQUIRED THE DEVELOP~ TO PROVIDE ~DSC~ING ALONG THE INTER~ T~IL PRIOR TO OCCUP~CY OF P~SE I OF 4THE S~E~LL. 5 ~S, Ordinance No. 4627 approved by the City Council of the City of Auburn on April 28, 1993 provided for the 7 rezone of approximately 60 acres of property from M-1 to C-3 8 and adopted certain conditions of approval; and 9 ~ER~S, condition No. 8.K.3. of Ordinance No. 4627 ~0 requires a 10 foot width of Type II landscaping to be planted along the Interurban trail prior to the occupancy of Phase I ~ of the Supe~a11; and ~ ~ER~S, the Supermall has requested that condition No. ~ 8.K.3. of Ordinance No. 4627 be revised so that the ~ landscaping next,to the Interurban Trail not be required as ~ part of Phase I; and ]7 ~ER~S, Condition No. 20 of Ordinance No. 4627 allows 18 amendments to be made to said Ordinance; and ~9 ~ER~S, the proposed amendment to Ordinance No. 4627 ~0 considered a minor change and has therefore been reviewed by 2~ the Planning and Co,unity Development Co~ittee of the Council and approved by the City Council; NOW, THEREFORE, THE CITY CO~CIL OF THE CITY OF AUB~, WASHINGTON, DOES O~AIN AS FOLLOWS: 25 Ordinance No. 4742 April 21, 1994 Page i ! ~ City of Auburn Ordinance No. 4627 approved by 2 the City Council on April 28, 1993, is hereby amended to 3 revise Condition No. 8.K.3. A copy of said revised Condition 4 No. 8.K.3 is attached hereto as Attachment "A". 5 ~ The effective date of this Ordinance is when 6 the letter of credit required by the revised condition No. 7 8.K.3 of this Ordinance and the agreement required by the 8 revised condition of No. 8.K.3 of this Ordinance have been 9 received and approved by the City of Auburn Attorney's l0 office. l! Section 3, Ail remaining sections and amendments to ~ 12 Ordinance No. 4627 shall remain in full force and effect.  13 Section 4. The Mayor is hereby authorized to implement ~ 14 such administrative procedures as may be necessary to carry ~ 15 out the directives of this legislation. ~ 16 ~Q~_~. The applicant shall be responsible for making the following improvements related to the Interurban 4 Trail as part of phase I. 5 1. A raised median shall be constructed on 15th Street SW to provide a crossing refuge for the 6 Interurban Trail. The refuge shall be large enough to accommodate six bicyclists. Warning 7 signs shall be installed on 15th Street SW and on the Interurban Trail that indicate the 8 approaching intersection. 9 2. Convenient and safe access shall be provided from the trail to the parking lot and then to 10 the mall building. Bicycle parking facilities shall be provided in convenient locations. 3. A ten foot width of type II landscaping shall 12 be provided along or within the west boundary of the right-of-way for the trail, except for 13 access points to the shopping center. If landscaping is provided within the right-of- 14 way, then provisions acceptable to the Planning Director for planting and perpetual maintenance 15 of the landscaping shall be included in any agreement for right-of-way use. a.
