Auburn, WA 98001 JUL 2 0 1995 KING COUN~'Y ORDZNANCE NO. · 7 4 6 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY .OF AUBURN, WASHINGTON, APPROVING THE VACATION OF AN ALLEY RIGHT OF WAY LOCATED SOUTH OF EAST MAIN STREET AND EAST OF "D"' STREET S.E., WITHIN THE CITY OF AUBURN, WASHINGTON. WHEREAS, Petition No. V-04-94 has been filed by the owners of two-thirds or more of the property abutting the portion of right of way requested to be vacated; and WHEREAS, RCW 35.79.010 requires that the City Council schedule a public hearing when a valid petition is filed with the City; and WHEREAS, the public hearing was held on iMay 15, 1995 before the City Council; NOW, THEREFORE, CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section ~. The alley right of way to be vacated is located on that portion of land between south of East Main Street and east of "D" Street Southeast, within the City of Auburn, Washington, legally described as follows: BEGINNING AT THE SOUTHWEST CORNER OF LOT "A", BLOCK ONE OF TRUITTS FIRST ADDITION TO AUBURN AS RECORDED IN VOLUME 14 OF PLATS, PAGE 51 RECORDS OF KING COUNTY, WASHINGTON; THENCE EASTERLY ALONG 'THE SOUTH BOUNDARY OF LOTS 'A' AND "B" AND "C" OF SAID BLOCK ONE TO THE SOUTHEAST CO~IER Ordinance No. 4746 May 15, 1995 Page 1 I I i 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 OF SAID LOT "C"; THENCE SOUTHERLY TO THE NORTHEAST CORNER OF LOT NO. i OF SAID BLOCK ONE; THENCE WESTERLY ALONG THE NORTH BOUNDARY OF SAID LOT NO. i TO THE NORTHWEST CORNER THEREOF; THENCE NORTHERLY TO THE POINT OF BEGINNING. be and the same is hereby vacated upon the compliance with all conditions of CUP0001-95, and the property lying in said portion of a certain alley right of way described hereinabove, shall be returned and. belong to those persons entitled to receive the property in accordance with the law. 8eation 2. The City hereby retains an eas~ement for the construction, repair and maintenance of utilities over, across, upon and underneath the property described in Section 1 of this Ordinance. ~ Seation 3.
