AN ORDINANCE OF THE CITY OF AUBURN AUTHORIZING THE CITY TO
ACCEPT GRANT FUNDS FOR CONSTRUCTING INFRASTRUCTURE PROJECTS ON
BEHALF OF THE NORTHWEST RACING ASSOCIATION, WHICH ARE APPROVED
BY THE WSDOT LOCAL PROGRAMS ENGINEER FOR FUNDING UNDER SECTION
228 OF SECOND ENGROSSED SENATE HOUSE 2080.PL TITLED: "FOR THE
DEPARTMENT OF TRANSPORTATION LOCAL PROGRAMS--PROGRAM Z',
WHEREAS, the' City Council of the City of Auburn must
adopt and approve all appropriations by Ordinance pursuant to
Chapter 35A.33 RCW; and
WHEREAS, on January 3, 1995 the City Council adopted
Resolution No. 2588 authorizing the Mayor to file an
application for CERB (Community Economic Revitalization Board)
grant funds to construct a specific list of infrastructure
projects necessary for the Racetrack; and
WHEREAS, under ESHB 2080 the Legislature reprogrammed $4
million of the original $5 million to the Local Programs
Account of WSDOT which is available July 1, 1995 and is valid
for a period of two years; and
WHEREAS, it is understood that only the City can secure
the use of these funds for the benefit of the Racetrack and
that the management of this work will require the utilization
of City Engineer Staff which would defer other scheduled City
projects without the procurement of additional professional
services which will be paid for by the grant;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. Pursuant to Chapter 35A.33 RCW, the City
Council hereby approves the expenditure and appropriation of
State Special Grant Funds provided by Second Engrossed Senate
House 2080.PL, Section 228, Titled: "For the Department of
Transportation Local Programs--Program Z", a copy of said
Section is attached hereto, denominated as Exhibit "A" and
made a part hereof as though set forth in full, for design,
right of way, and construction of eligible projects as defined
in the CERB grant application and hereby authorizes the Mayor
and the City Clerk to execute an Agreement between the City
and WSDOT Local Programs to secure the appropriated funds.

3 during the 1995-97 biennium. For the purposes of this section, the
4 expenditures for compensation paid to ferry employees shall be limited
5 to salaries and wages and employee benefits as defined in the office of
6 financial management's policies, regulations, and procedures named
7 under objects of expenditure "A" and "B" (7.2.6.2).
8 The prescribed salary and insurance benefit increase or decrease
9 dollar amount that shall be allocated from the governor's compensation
10 appropriations is in addition to the appropriation contained in this
11 section and may be used to increase or decrease compensation costs,
12 effective July 1, 1995, and thereafter, as established in the 1995-97
13 general fund operating budget.
14 (3) The appropriation in this section includes $614,000 for the
15 automated ticket vending program. These funds shall be expended only
16 in accordance with the implementation of the automated ticket vending
17 program.
18 (4) The department of transportation shall provide to the
19 legislative transportation committee and office of financial management
20 a quarterly financial report concerning the status of the operating
21 program authorized in this section.

29 The appropriations in this section are subject to the following
30 conditions and limitations and specified amounts are provided solely
31 for that activity:
32 (1) Up to $13,100,000 of the motor vehicle fund--federal
33 appropriation in this section is provided for construction of
34 demonstration projects specified in the federal intermodal surface
35 transportation efficiency act (P.L. 101-240; 105 Stat. 1914). The
36 motor vehicle fund--state appropriation includes $3,275,000 in proceeds
37 from the sale of bonds authorized in RCW 47.10.819(1) for the federal

~atch requirements. However, the transportation commission may
authorize the use of current revenues available to the department of
transportation in lieu of bond proceeds for any part of the state
appropriation.
(2) $5,000,000 of the motor vehicle fund--federal appropriation,
transportation enhancement moneys, in this section shall be used in the
folloWing manner: Up to $3,700,000 shall be used for the preservation
of abandoned freight rail corridors; and $1,300,000 shall be used for
rehabilitation of the King Street Station in the City of Seattle. That
portion of the $3,700,000 for preservation of abandoned freight rail
corridors that is not used for that purpose by April 1, 1996, shall be
used for the rehabilitation of the King Street Station.
(3) The motor vehicle fund--state appropriation in this section
includes $1,750,000 solely to fund the state's share of the east marine
view drive project. This amount represents a reappropriation of the
funding first provided for Everett homeport transportation projects in
1987. With this reappropriation, the legislature has fulfilled its
commitment for funding of special transportation projects associated
with the Everett homeport.
(4) Up to $1,430,000 of the motor vehicle fund--state appropriation
contained in this section shall be used for evaluations that mutually
benefit cities, counties, and the state department of transportation.
The evaluations may include fuel tax evasion, license fraud, access
management, regional mobility, and miscellaneous cost/benefit measures,
as determined by the legislative transportation committee. Of this
amount, up to $750,000 may be used to develop a regional mobility plan
that includes, but is not limited to, highways, paratransit,
ridesharing, targeted telecommuting, no-fare transit, and vanpool
subsidies on a least cost basis; a high occupancy vehicle lane
completion analysis; and recommended statutory changes that would allow
the plan to be submitted to a public vote by the regional transit
authority.
(5) $4,000,000 of the motor vehicle fund--state appropriation in
this section is provided solely for infrastructure associated with
development of a horse racetrack in western Washington. With this
appropriation, the state has fulfilled its commitment to provide
