HomeMy WebLinkAbout4769O iGINA 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 7 6 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING CHAPTER 10.36 ENTITLED "STOPPING, STANDING A/~D PAR/lING# BY AMENDING SECTION 10.36.268 ENTITLED "DISABLED PARKING - VIOLATION." CONTAINED IN AUBURN CITY CODE TITLE 10 ENTITLED "VEHICLES AND TRAFFIC" TO INCREASE FINE FROM FIFTY DOLLARS TO ONE HUNDRED SEVENTY-FIVE DOLLARS. WHEREAS, the Washington State legislature has provided that the penalty applying to the parking infraction imposed on any person parking a vehicle in a vehicle parking place reserved for physically disabled persons without a special license or placard be increased; and WHEREAS, that the Washington State legislature has provided that enforcement ordinances relating to and regulating municipal affairs that are the same as the state statutes, must contain the same punishment as the state statute. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. as follows: To amend AND PARKING" by amending section PURPOSE. The purpose of this Ordinance is Chapter 10.36 entitled "STOPPING, 10.36.268 entitled STANDING "DISABLED Ordinance No. 4769 June 6, 1994 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 PARKING - VIOLATION." contained in Auburn City Code Title 10 entitled "VEHICLES AND TRAFFIC". Section 2. Section 10.36.268 is adopted as set forth in Exhibit "A" attached hereto and incorporated herein by this reference. Section 3, Constit~tional~t¥ or Invalidity. If any section, subsection, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed, adopted and approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. This Ordinance shall take effect and be in force five days from and after its passage, approval, and publication as provided by law. A. A parking space or stall for a physically disabled person shall be indicated by: pavement situated in the center of designating handicap parking for public parking; and A painted state-approved handicap symbol on the the parking stall and private property 2. A vertical sign, between 48 and 60 inches off the ground, with the international symbol of access described under RCW 70.92.120 displaying the notice "State disabled OrdinanceNo. 4769Exhibit"A" June 7,1994 Page5 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1 2 3 4 5 6 parking permit required" and a warning that other vehicles without permits will be impounded. B. Any person who meets the criteria for special parking privileges under Chapter 46.16 RCW shall be allowed free of charge to park a vehicle being used to transport that person for unlimited periods of time which are otherwise restricted as to permitted. This section does not in parking zones or areas length of time parking is apply to those zones or areas in which the stopping, parking or standing of all vehicles is prohibited or which are reserved for special types of vehicles. The person shall obtain and disp].ay a special card, decal, or license plate under Chapter 46.16 RCW to be eligible for the privileges set forth in this section. C. No person shall stop, stand or park a vehicle in a properly posted and marked parking space or stall indicated for a physically disabled person as provided in subsection A for any purpose or length of time unless such vehicle displays a special license plate, card or decal vehicle is being used to transport a defined under Chapter 46.16 RCW. D. A vehicle may be impounded with and giving prior notice to its owner when indicating that the disabled person as a parking citation a vehicle without a Ordinance No. 4769 Exhibit 'A' June 7, 1994 Page 6 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 special license plate, card, or decal indicating that the vehicle is being used to transport a disabled person as defined under Chapter 46.16 RCW is parked in a stall or space clearly and conspicuously marked therefor whether the space is provided on private property without charge or on public property, as signed and marked as set forth in subsection A of this section. The issuance of a previous parking citation to said vehicle for violation of the terms of this ~section shall constitute said prior notice. E.
