AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING THE VACATION OF THE ALLEY SOUTH OF 8TH
STREET SE AND EAST OF "D" STREET SE, WITHIN THE CITY OF
AUBURN, WASHINGTON.
WHEREAS, Petition No, V-01-95 has been filed by the
owners of two-thirds or more of the property abutting the
portion of right of way requested to be vacated; and
WHEREAS, the statute requires that the City Council
schedule a public hearing when a valid petition is filed with
the City; and
WHEREAS, the public hearing was held on August 22,
before the City Council;
NOW, THEREFORE, CITY COUNCIL OF THE CITY OF
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The alley to be vacated is located south of
8th Street Southeast and east of "D" Street Southeast, legally
described as follows:

BEGINNING AT THE SOUTHWEST CORNER OF
LOT 9, BLOCK 7 OF HART'S FIRST
ADDITION TO THE TOWN OF AUBURN AS
RECORDED IN VOLUME 20 OF PLATS, PAGE
23, RECORDS OF KING COUNTY,
WASHINGTON; THENCE SOUTH 89-22-10
WEST ALONG THE SOUTHERLY BOUNDARIES
OF LOTS 8, 7 AND 6 ALL IN SAID BLOCK
7 OF HART'S FIRST ADDITION TO THE
TOWN OF AUBURN, 90.00 FEET TO THE
SOUTHWEST CORNER OF SAID LOT 6;
THENCE SOUTH 00-37-50 EAST, 16.00

be and the same is hereby vacated, and the property lying in
said portion of a certain street right of way described
hereinabove, shall be returned and belong to those persons
entitled to receive the property in accordance with the law.
Se~tlon 2. The alley vacation is subject to lot line
adjustment under tax parcel numbers 192105-907.4-01, 192105-
9126-09, 314160-0607-00 and the parcel located between parcels
and 192105-9126-09 and south of the vacated
192105-9074-01
alley.
Section 3.
The City shall retain a utility easement for
the construction, repair and maintenance of all utilities
over, across, upon and underneath the property described in
Section 1 of this Ordinance.
Section 4. Upon the passage, approval and publication
of this Ordinance, the City Clerk for the City of Auburn shall
cause this Ordinance to be recorded in the office of the King
County Auditor.
