AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
3 WASHINGTON, RELATING TO PLANNNING; ADOPTING THE COMPREHENSIVE
4 PLAN MAP AND TEXT AMENDMENTS FOR THE CITY OF AUBURN,
WASHINGTON, PURSUANT TO THE PROVISIONS OF R.C.W. CHAPTERS
36.70A AND 35A.63 OF THE LAWS OF THE STATE OF WASHINGTON;
5 DESIGNATING THESE AMENDMENTS AS GUIDELINES FOR EXERCISING THE
CITY'S AUTHORITY UNDER THE WASHINGTON STATE ENVIRONMENTAL
6 POLICY ACT (SEPA); DIRECTING THAT THIS ORDINANCE AND
7 COMPREHENSIVE PLAN TEXT AMENDMENTS IT ADOPTS AND APPROVES BE
FILED WITH THE AUBURN CITY CLERK AND BE AVAILABLE FOR PUBLIC
8 INSPECTION; RATIFYING AND CONFIRMING RESOLUTION NO. 2635.

WHEREAS, by Resolution 2635 (April 17, 1995), the City of

Auburn adopted its Comprehensive Plan, including map and text
amendments and recitals, which recitals are incorporated
12 herein by this reference; and
WHEREAS, the Central Puget Sound Growth Management
14 Hearings Board on August 30, 1995 issued an Order requiring
15
the City of Auburn to adopt a comprehensive plan by ordinance,
rather than resolution, no later than 5:00 p.m. on Friday,
October 6, 1995; and
WHEREAS, this Comprehensive Plan is being adopted
pursuant to the Growth Management Act, Chapter 36.70A RCW; and

WHEREAS, the City of Auburn disagrees that the

Comprehensive Plan must be adopted by ordinance in order to be

adopted pursuant to the Growth Management Act, Chapter 36.70A
23
and is taking steps to request the Central Puget Sound Growth
24
Management Hearings Board reconsider its decision; and

2 WHEREAS, the presentation and passage of this ordinance
3 is not in any way intended to waive any rights the City has or
4 may have to challenge the Central Puget Sound Growth
5 Management Hearings Board's decision as represented in its
6 August 30, 1995 Order; and
7 WHEREAS, pending such reconsideration and/or possible
8 appeal(s) to courts, the City of Auburn's purpose in
9 submitting this ordinance for passage is to address the
10 Board's concerns as expressed in its August 30, 1995 order.
1! NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
12 WASHINGTON, DO ORDAIN AS FOLLOWS:
13 Seation 1. The Draft Amended Comprehensive Plan, Draft
14 Capital Facilities Plan, and Planning and Community
15 Development Committee's Recommended Amendments (all attached
16 to City Resolution 2635) are herewith adopted and approved and
17 it is herewith directed that they be filed along with this
18 Ordinance with the Auburn City Clerk and be available for
19 public inspection.
20 Seatlan 2. The Comprehensive Plan Map and text
21 amendments modify the Comprehensive Plan adopted on August 18,
22 1987 by Resolution 1703.
23 Seation 3. The Comprehensive Plan and amendments is
24 herewith designated as a basis for the exercise of substantive
25 authority under the Washington State Environmental Policy Act

2 by the City's responsible environmental official in accordance
with R.C.W. 43.21C.060.
4 Seotlon 4. If any section, subsection, sentence, clause,
5 phrase or portion of this Ordinance or any of the
Comprehensive Plan amendments adopted herein, is for any
7 reason held invalid or unconstitutional by any Court of
competent jurisdiction, such portion shall be deemed a
8
9 separate, distinct and indeDendent provision, and such holding
10 shall not affect the validity of the remaining portions
thereof.

12 Seotion 5. The Mayor is hereby authorized to implement
!3 such administrative procedures as may be necessary to carry
14 out the directions of this legislation to include
!5 incorporating into one document the adopted Comprehensive Plan
and Comprehensive Plan Map and text amendments, attached
]7 hereto as Exhibit "A" to Resolution No. 2635, and preparing
and publishing the amended Comprehensive Plan.

19 Section 6. Resolution No. 2635, and any other action
20 taken consistent with but prior to the adoption of this
21 Ordinance, is ratified and confirmed.
22 Section 7. This Ordinance shall take effect and be in
23 force five days from and after its passage, approval, and
24 publication as provided by law.
