HomeMy WebLinkAbout48112 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 ORI IIV L ORDINANCE NO. 4811 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, APPROVING TRANSPORTATION IMPROVEMENT BOARD (TIB) GRANT FUNDS WITH LOCAL MATCHING FUNDS AS PROVIDED IN THE PROJECT AGREEMENT BETWEEN THE CITY AND THE TIB FOR AUBURN WAY SOUTH/BURLINGTON NORTHERN RAILROAD PROJECT. WHEREAS, the City Council of the City of Auburn must adopt and approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW; and THE CITY COUNCIL OF THE ORDAIN AS FOLLOWS: Section 1. Pursuant Council hereby approves the Transportation Account (UATA) matching funds the Auburn Way CITY OF AUBURN, WASHINGTON, DO to Chapter 35A.33 RCW, the City expenditure and appropriation of Improvement Board of Urban Arterial Trust Funds in the amount of $1,905,000.00 with local of $548,800.00 from the 102 Gas Tax Fund for South/Burlington Northern Railroad Project No. 507 and authorizes the Mayor to execute between the City and the Transportation Improvement approving said Agreement, a copy of which is attached as Exhibit "A" and is incorporated herein by reference. Project Agreement Board hereto Section 2. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. If the costs of the project exceed the amount of UATA funds authOr=ed by the Transportation Improvament Board, set forth above, and the required local matching funds and othar funds represented by the local agency to be committed to the IXOjest. the local agency will pay all additional costs necesse~'y to complets the project as submitted to the Board. This shall not prevent the local agency fram requesting an increase in the amount of rust funds pursuant to applicable rules of the Board. IN COHSlDERATION of the promises and pederrnance of the stated conditions by the agency, the Trenspellation Improvement Board ha'eby agrees to pay the agency fi.am UATA funds allocated, and not othenvtse, for its eiiDible costs d~',g the ensuing quarter year not to exceed the amount specified above. Such obligation to pay UATA funds extends only to project cost incurred after the date o1 the Board's allocation funds and authorization to proceed with the project.
