HomeMy WebLinkAbout4815 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 8 I 5 AN ORDINANCE OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, AMENDING AUBURN MUNICIPAL CODE SECTION 2.14.030 TO PROVIDE FOR THE ELECTED MUNICIPAL COURT JUDGE BEGINNING JANUARY 1, 1998. WHEREAS, RCW 3.50.055 provides that a City , shall transition to an elected Municipal Judge when the full time equivalent position is achieved which is defined as thirty- five of more hours per week compensated time, WHEREAS, Ordinance No. 4809 established a sequencing to conform to the state statute for elected municipal court judges by allowing a two year appointment of the municipal court judge to provide for an elected judge to begin serving January 1, 1998 which is in compliance with the state statue for elected municipal court judges, WHEREAS, the current hours, combined with the anticipated additional number of cases result in a conclusion that is highly likely that a municipal court judge will be at or near thirty- five or more hours per week of compensated time near the end of the two year appointment, December 31, 1997. Auburn City Code Section 2.14.030 Judges- Appointment - Qualifications is amended to read as follows: 2.14.030 Judqes - Appoint - Qualifications. ae The municipal court judge shall be appointed by the mayor, subject to confirmation by the city council, for the term beqinninq January 1, 1996, which term shall be for two years ending December 31, 1997. The MuniciDal Court Judqe shall be elected for the term beqinning January 1, 1998, for a term of four years commencinq January 1, 1998 and endinq December 31, 2001, and elected every four years thereafter. A person appointed as municipal court judge shall be a citizen of the United States of America and of the state of Washington, and an attorney admitted to practice law before the courts of record of the state of Washington. A Municipal Court Judge shall be elected in the same manner as other elective City officials are elected to office. SECTION 2. If any provision of this Ordinance, or code provision amended by this Ordinance is determined to be Ordinance No. 4815 December 1, 1995 Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 invalid or unenforceable for any reason the remaining provisions of this Ordinance and the Code Provision amended here by shall remain in force and effect. SECTION 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. SECTION 4. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
