AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING FEDERAL ISTEA GRANT FUNDS WITH LOCAL
MATCHING FUNDS AS PROVIDED IN THE LOCAL AGENCY AGREEMENT
BETWEEN THE CITY AND THE WASHINGTON STATE DEPARTMENT OF
TRANSPORTATION TO PREPARE AND IMPLEMENT THE SIGNALIZATION OF
THE INTERSECTION AT "A" STREET SE AND 6TH STREET SE.
WHEREAS, the City Council of the City of Auburn must
adopt and approve all appropriations by Ordinance pursuant to
Chapter 35A.33 RCW; and
THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Pursuant to Chapter 35A.33 RCW, the City
Council hereby approves the expenditure and appropriation of
Federal ISTEA Grant Funds in the amount of $108,000.00 with
local matching funds of $63,000.00 from the 102 Gas Tax Fund
to prepare and implement the signalization of the intersection
at "A" Street SE and 6th Street SE and authorizes the Mayor to
execute Local Agency Agreement No. LA1845 between the City and
the Washington State Department of Transportation approving
said Agreement, a copy of which is attached hereto as Exhibit
"A" and is incorporated herein by reference.
Section 2. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.

and Federal-aid requirements. The salary of such engineer or other super-
~ and all other salaries and costs incurred by State forces upon the
pm~ect will be co~sidered a cosl thereof. All costs relaled to this prbjecl
incu~ed by emp~yees of the Slale in the customary manner on highway
payrolls and vouchers shall be charged es costs of the project
IV AVAILABILITY OF RECORDS
Alt pro,act records in support of all costs incurred arid actual expendi*
lures kepi by the Agency, are to be maintained in accordance with proce*
dm*es l~escrihed by the Division of Municipal Corporations of Ihe Slate
Audilo~.*s Office. the U.S Department of Transportation and Washington
Department of Transporfalion. The records shall be open Io inspeclion by
[he Stale and Federal Governmenl al all reasonable times and shall be
.etained and made available for such inspection for a period of not less

V COMPLIANCE WITH PROVISIONS
The Agency shall not incur any Federal-aid participation costs on any
classification of work on lifts proj~'l until atflhorized in writing by the Stale

2. Preparatior~ of Plans. Specitications. and Estimates
3. Riehl-of-Way Acquisition
4. Project Construclion
In lhe event that Right-of-Way acquisition for, of actual conslruction of
the road Ior which Preliminary Enginaedng is undedaken is col slarted by
the closing of Ihe fifth liacal year following Ihe fiscal year in which the agree-
menl is executed. Ihe Agency will repay to Ihe Slate the sum or sums ol
Federal funds paid to the Agoncy under the lerms of this agreement. (See

The Agency agt'ees that all sieges of construction necessary Io ~o-
vide Ihe initially plan~ed compiole facility, within the limits ol this proleCt, will
conform to at least Ihe m~imum values set by approved AASHTO design
standards a~blicable ID this class of highways, even though such ar~litional
work is financed withoul Federal-aid participation.

VI PAYMENT AND PARTIAL REIMBURSEMENT
The Iolal cost of the proiect, including all review and engineenng costs
and other expenses ol the Stale. is Io be paid by the Agency and by the
Federal Government. Federal funding shall be in accord with the Surface
Transportation Asalslance Act t978, ~lle 23, Untied States Code, as
amended, and Office of Management and Sudgel Circulars A-102 and
A- 128 The Stale shall nol be ultimately responsible for any of the costs of
the project. The Agm'~c'y shall be ultimately responsible for all costs essoci-
aled with Ihe p~oject which are not reimbursed by Ihe Federal Government,
Nothing in this agreement shall be construed as a I~omise by Ihe State as
Io the amcunt or nalure of Federal participation in this project,
