AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING FEDERAL ISTEA GRANT FUNDS WITH LOCAL
MATCHING FUNDS AS PROVIDED IN THE SPECIAL TRANSPORTATION
PLANNING STUDY AGREEMENT BETWEEN THE CITY AND THE WASHINGTON
STATE DEPARTMENT OF TRANSPORTATION TO PREPARE A CITY
TRANSPORTATION COMPREHENSIVE PLAN UPDATE.
WHEREAS, the City Council of the City of Auburn must
adopt and approve all appropriations by Ordinance pursuant to
Chapter 35A.33 RCW; and
THE CITY COUNCIL OF THE
ORDAIN AS FOLLOWS:
Section 1. Pursuant to Chapter 35A.33
Council hereby approves the expenditure and

NOW THEREFORE, it is mutual~ agreed as follows:

SCOPE OF WORK
The PLANNING AGENCY shall undertake ~e Transportation
Planning Project described above, which shall include the tasks set forth in
Exhibit 'A,' attached hereto.
II
SCHEDULE
The project pedod shall commence upon exeou~on of this agreement
and shall last until the expiral~on data listed above.
III
PAYMENT
The STATE agrees to reimburse the PLANNING AGENCY's actual
direct and mlatad indirect costs of the project. The maximum amount that ere
STATE shall reimburse ~ PLANNING AGENCY shall not exceed the 'Total
Amount Authorized' listed above. Payment by task shall ha made as set kxth
in Exhibit 'A.' NI costs must be consistent with the Federal cest i~xinciples
contained in OMB Circular A-87.
The PLANNING AGENCY shall submit to the STATE re~Jesta for
funds es they are · xgee~.~ on ~ Ixoject, but not to exceed one such request
every month. Such re~uasta for reimbursement shall document the amount
of funds that have been expo~ded during the pe~:x:l for the total po:~e~t, as
wel as k~' the corrsat bitiing po~o¢l. The STATE shall review and approve
each request for payment in an expe~tious manner and shall make payment
within 30 days afler approval of the paymsat request.

REPORTS
The PLANNING AGENCY shall, from time te time during the progress
of the wod(, confer with the STATE. The PLANNING AGENCY shall prepare
and present quarlerly progress reports Ior each caJendar quarter during the
c~xJme of the project. Each such progress report shall be submitted nn later
· an 21 calender days following the end of the reporting peried. Each
progress report shall include such infermatico as may be pe~inent and
nacassery or as may he mqnastad, in writing, by the STATE in order to pass
~ judgment on features of the work, including expenditures (qua~l~ly
and to-date), work progress, and problems. The PLANNING AGENCY shall
make such changes, amendments, or revisions in ~ detail of the work as
may be required by the STATE.
A rmal report documenting the planning project, including integra sad
tar~ reports which provide documentation of all technical data and their
analy-;s, shall be prepared by the PLANNING AGENCY. The PLANNING
AGENCY shall submit five (x~olas of the tinal report to the STATE kx
acceptance. This requirement fo~ a final report may be waived in writing by the
STATE.

Either party may request changes in these previsions. Such changes
which are mutually agreed upon shall be incorporated as writtan amendments

RETENTION OF RECORI)I)
The STATE. and any of its representatives, shall have full access to
and ~e right to examine, du~ng normal business hours and as often as they
deem necessary, all of the PLANNING AGENCY's records with respect to all
matta~ covered by this conlract. Such mflresantatives shall be permitted to
audit, examine, sad make exseq~ts or transc~pts from such records and to
make audits of all contracts, invoices, matMials, payrolls, and other matters
covMed by Ihis contract. All documen ts, papers acomun ting records, and oIhe~
matMial pertaining to costs incurred in connoctinn with the pro~ct shall be
retaJnad by the PLAN NINGAGENCY for throe years after the STATE's writton
notice that the project is complete and the Agreement is terminated. Coffees
thereof shall be furnished if requested.
In accordance with OM8 Circular A- 128 regulations, the PLANNING
AGENCY is required to amange for audit of funds expanded.
