RO (RESIDENTIAL OFFICE) LOCATED AT 1116 HARVEY ROAD TO BE USED
AS A CHILD DAY CARE, WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Application No. CUP0011-95 dated October 16,
1995, together with site plans therefore, has been submitted
to the City of Auburn, Washington, by LOWELL and JOYCE WICKLrM,
requesting a Conditional Use Permit to allow a building in a
RO (Residential Office) zone located at 1116 Harvey Road to be
used as a child day care, within the City of Auburn,
Washington, hereinafter described in Section 2 of the
Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on November 21, 1995, at the
conclusion of which the Hearing Examiner recommended the
approval of the issuance of a Conditional Use Permit to allow
a building to be used as a child day care

FINDINGS OF FACT
The applicants, Lowell and Joyce Wikum, apply for
conditional use permit to develop a day care facility.
The subject property is located at 1116 Harvey Road, and
is currently zoned RO, Residential Office. It is
currently a vacant day care facility.
The day care facility is permitted subject to the
issuance of a conditional use permit.
The building at this address, 1116 Harvey Road, is part
of a day care complex. The building next door at 922
12th Street NE is part of the same facility. The
building next door has been operating as a day care
previously and has been properly permitted by the City of
Auburn. However, the subject property had been operating
as a day care, but had not received proper permits.
Both buildings are currently vacant. The applicants
anticipate opening the day care in January, 1996. A
total of 50 children will be occupying both buildings and
about 20 will be in the subject property building. There
will be approximately 10 employees with 7 'there at any
one time.
There are a total of 17 parking spaces on the two
parcels. An on-site visit establishes that there are
adequate drop off and pick up areas for the children, and
the Zoning Code requirements concerning parking are
established by the area in the site plan.
The building on the subject property contains
approximately 1800 square feet. Improvements may be
required to provide for alarm and/or fire sprinkler
systems. The Fire Code requirement is based on occupancy

of the building. The applicant needs to contact the Fire
Department for the specific code requirements.
There was no public opposition to the request.
CONCLUSIONS OF LAW
A day care has been operating in this and the adjacent
site for a number of years. There is no indication that
if a permit were issued that there would be adverse
effects in the neighborhood.
The proposal is in accord with the goals, policies, and
objectives of the Comprehensive Plan. The Comprehensive
Plan seeks to maintain and enhance Auburn's character as
a family oriented community.
The proposal complies with and/or is capable of complying
with all equlrements of the Zoning Ordinance.

The proposal can be constructed and maintained so as to
be harmonious and appropriate in design, character, and
appearance with the existing or intended character of the
general vicinity.
5. The proposal will not adversely affect the public
infrastructure.
For each of the above referenced reasons, the
recommendation of the Hearing Examiner to the Auburn City
Council on this Conditional Use Permit to allow a building to
be used as a child day care in a RO (Residential Office) zone
located at 1116 Harvey Road is approved.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. The above cited Hearing Examiner's Findings
of Fact and Conclusions, are herewith incorporated in this
Ordinance.
Section 2. A Conditional Use Permit is hereby approved
to allow a building to be used as a child day care in a RO
(Residential Office) zone located at 1116 Harvey Road, within
the City of Auburn, County of King, State of Washington,
legally described as follows:
The south 65 feet of the north 155 feet of
Lots 22 through 27, inclusive, Block 16,
C.D. Hillman's Auburndale Addition to the
City of Seattle, Division No. 2, according
to the plat thereof recorded in Volume 13
of Plats, page 92, in King County,
Washington; EXCEPT that portion which lies
southwesterly at the northeasterly line of
Harvey Road.
Section 3. Since two buildings share common facilities,
i.e., parking, this permit should be approved on the basis
that the two buildings are one day care facility.
~ection 4. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.
Section 5. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
