AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
THE REZONING OF PROPERTY LOCATED AT 1320 AUBURN WAY SOUTH,
WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING
CLASSIFICATION THEREOF FROM R-3 (DUPLEX) TO "I"
(INSTITUTIONAL).
WHEREAS, Application No. REZ0003-95 has been submitted to
the Council of the City of Auburn, Washington, by the BIBLE
BAPTIST CHURCH, requesting the rezoning of the real property
hereinafter described in Section 2 of the Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on January 17, 1996, at the
conclusion of which the Hearing Examiner recommended the
approval of the rezoning of said property; and
WHEREAS, the City Council, on February 5, 1996,
considered said request and affirmed the Hearing Examiner's
recommendation for rezone based upon the following Findings of
Fact and Conclusions, to-wit:

FINDINGS 0F FACT
The applicant, Bible Baptist Church, requests a rezone
from R-3 to "I", Institutional, on property located
adjacent and east of the church. The church is located
at 1320 Auburn Way South. The proposed rezone consists
of 5 separate lots which each currently contain a single
family home. The rezone parcel is 1.25 acres in size.
The evidence establishes that the church plans to remove
each of the single family homes to accommodate a planned
expansion of the church. The church plans to construct a
40,000 square foot multi-purpose sanctuary as an addition
to the existing church facility. There will be 137
parking spaces.
The City Council approved in December of 1995 a
Comprehensive Plan designation for the subject site which
is Public/Quasi-Public. This designation is appropriate
for the institutional zone since this institutional zone
is intended for purposes such as educational,
theological, recreational, cultural, and other quasi-
public and public uses. The institutional zone also
lists ~religious institutions" as a permitted use.
The proposed rezone will abut "M" Street SE to the east.
This street is a designated arterial with a heavy travel
count. To the south is a single family home, and to the
north is a duplex.
The City issued a Mitigated Determination of Non-
Significance on January 2, 1996. This MDNS contained 10
conditions of approval addressing erosion control, storm
drainage, landscaping, and other issues regarding
construction of the church.

CONCLUSIONS OF LAW
For each of the above reasons, the recommendation of the
Hearing Examiner is approval of the rezone as it is
consistent with the Comprehensive Plan map designations,
zoning, and existing uses.
For each of the above referenced reasons, the
recommendation of the Hearing Examiner to the Auburn City
Council on this rezone from R-3 (Duplex) to "I"
(Institutional) is approved and affirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
~9_~. The above cited Hearing Examiner's Findings
of Fact and Conclusions, are herewith incorporated in this
Ordinance.
~ The following described property located at
1320 Auburn Way South, situate in the City of Auburn, County
of King, State of Washington, be and the same is hereby
rezoned from R-3 (Duplex) to "I" (Institutional) and legally
described:
Lots 3 through 7 of the Shadrach Evans
Addition as recorded in Volume 49, Page 29
of Plats, records of King County,
Washington.

~ Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the Kin9 County Auditor, Division of Records and
Elections.
~ The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
~ This Ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as provided by law.
