HomeMy WebLinkAbout4839 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 8 3 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO ACCEPT A DONATION OF A BOAT TRAILER TO BE USED BY THE AUBURN FIRE DEPARTMENT TO TRANSPORT THE BOAT USED IN WATER RESCUES. WHEREAS, the City Council of the City of A~burn desires to accept the donation by Capt. Parry J. Boogard, Jr., of a boat trailer for use by the Auburn Fire Department for the public purpose of transporting the city's boat in water rescues; and WHEREAS, the City of Auburn has determined that such donation is for a public purpose and in the best interest of the City; THE CITY COUNCIL OF THE CITY OF AUBURN, ~SHINGTON, DO ORDAIN AS FOLLOWS: ~ ~ The purpose of this Ordinance is to accept the donation by Capt. Parry J. Boogard, Jr., of a boat trailer for use by the Auburn Fire Department for the public purpose of transporting the city's boat in water rescues and to enter into an Acceptance and Agreement which is attached hereto as Exhibit 'A' Ordinance No. 4839 February 20, 1996 Page I 1 2 3 4 5 6 7 8 9 l0 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 approves the Acceptance and marked Exhibit "A" which is herein as if fully set forth. ACCEPTANCE AND AGREEMENT The City hereby Agreement attached hereto and by this reference incorporated Section 3, The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. i~ This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. PARRY J. BOOGARD, JR., trailer for use by the Auburn Fire Department is behalf of the CITY OF AUBURN by CHARLES A. BOOTH, authorized by RCW 35A.11.040. of a boat accepted on Mayor, as The Auburn City Council has determined and declares that acceptance of the donation is for a public purpose and in the best interest of the CITY. AGREEMENT THE ABOVE ACCEPTANCE AND THIS AGREEMENT is made and entered into this ~ay of ~.~/t~_~ , 1996, by and between the CITY OF AUBURN, a municipal corporation of the State of Washington, whose address is 25 West Main, Auburn, Washington 98001, hereinafter referred to as "CITY" and CAPT. PARRY J. BOOGARD, JR., whose address is Auburn Fire Department, 1101 "D" St., NE, Auburn, Washing[ton 98002, hereinafter referred to as 'BOOGARD'. IN CONSIDERATION OF THE COVENANTS AND CONDITIONS CONTAINED HEREIN, THE PARTIES AGREE AS FOLLOWS: Exhibit 'A" Ordinance No. 4839 February 20, 1996 Page 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 The purpose of this Agreement is the acceptance by the CITY of a boat trailer to be used by the Auburn Fire Department for the public purpose of transporting the CITY'S boat in water rescues which boat trailer is described on the attached Exhibit "1" which is by this reference incorporated herein as if fully set forth. BOOGARD will donate the boat trailer described in the attached Exhibit "1". It is donated without condition for use by the Auburn Fire Department. CITY OF AUBURN CHARLES A. MY COMMISSION EXPIRES: 03/09/99 Exhibit "A" Ordinance No. 4839 February 20, 1996 Page 5 Property Desoription: 1994 Easyloader 16~ Boat Trailer Washington License # 9974LL ID# 1ZEiXCR16RAE23931 The boat trailer was built in 1994 by Easy Loader Inc. The trailer is 16' long, of galvanized steel constr%~ction and is grey in color. The trailer is equipped with 4 - 5' astro turf covered wood runners that are utilized to guide and support the boat's weight. The trailer has a flip down-adjustable height, hand cranked assembly with directional wheel. A hand ratcheted winch utilizing a 25'x 1/4" braided stainless steel cable and hook is attached to the trailers tongue. The trailer has a 2" ball receiver, 9 pin female electrical connector and emergency chains. The trailer has 2 - 12" 5 lug white spoke wheels and 2 - 12" 4 ply tires.
