HomeMy WebLinkAbout4844 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 8 4 4 AN ORDINANCE OF THE CITY OF AUBURN AUTHORIZING THE CITY TO ACCEPT GRANT FUNDS FOR CONSTRUCTING INFRASTRUCTURE PROJECTS ON BEHALF OF THE NORTHWEST RACING ASSOCIATION, WHICH ARE APPROVED BY THE WSDOT LOCAL PROGRAMS ENGINEER FOR FUNDING UNDER COMMUNITY ECONOMIC REVITALIZATION BOARD (CERB) TO SUPPORT THE DEVELOPMENT OF THE AUBURN THOROUGHBRED RACETRACK AND TO AMEND THE 1996 BUDGET FOR RECEIPT AND EXPENDITURE OF FUNDS. WHEREAS, the City Council of the City of Auburn must adopt and approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW; and WHEREAS, on January 3, 1995 the City Council adopted Resolution No. 2588 authorizing the Mayor to file an application for CERB (Community Economic Revitalization Board) grant funds to construct a specific list of infrastructure projects necessary for the Racetrack; and WHEREAS, under ESHB 2080 the Legislature reprogrammed $4 million of the original $5 million to the Local Programs Account of WSDOT which is available July 1, 1995 and is valid for a period of two years; and WHEREAS, it is understood that this authority addresses the residual One Million in funds remaining in the CERB account, after the aforestated Four Million were transferred, designated to support the development of the Auburn Thoroughbred Racetrack; WHEREAS, it is understood that only the City can secure the use of these funds for the benefit of the Racetrack and that the management of this work will require the utilization of City Engineer Staff which would defer other scheduled City Ordinance No. 4844 March 4, 1996 Page 1 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 1 2 3 4 5 projects without the procurement of additional professional services which will be paid for by the grant; and WHEREAS, it was not anticipated that this One Million Dollars in funds would be received in the 1996 budget and an emergency, therefore, is declared. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: ~ Pursuant to Chapter 35A.33 RCW, the City Council hereby approves the expenditure and appropriation of State Special Grant Funds provided by the Community Economic Revitalization Board (CERB), for design, right of way, and construction of eligible projects as defined in the CERB grant application and hereby authorizes the Mayor and the City Clerk to execute an Agreement between the City and WSDOT Local Programs to secure the appropriated funds. Section ~. In order to avoid the schedule impact on planned City projects the Public Works Director is hereby authorized to utilize these funds to secure professional services as needed. seotion $. The 1996 budget is hereby amended to reflect the receipt and expenditure of the above-referenced One Million Dollars. Beotion 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation.
