AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING
ORDINANCES NUMBERED 4845 AND 4913 WHICH APPROPRIATED COMMUNITY
6\O~ 4 DEVELOPMENT BLOCK GRANT (CDBG) FUNDS IN PRIOR 'YEARS SO THAT
5 CERTAIN UNUSED APPROPRIATED CDBG FUNDS ARE RELEASED IN ORDER
TO REAPPROPRIATE SUCH UNUSED CDBG GRANT FUNDS FOR USE DURING
6 THE 1997-98 CDBG PROGRAM YEAR THUS ADDING A TOTAL OF ONE
HUNDRED THREE THOUSAND NINE HUNDRED EIGHTY-FOUR DOLLARS
7 ($103,984) TO THE CDBG GRANT FUNDS APPROPRIATED FOR THE 1997-
8 98 PROGRAM YEAR IN THE AMOUNT OF FOUR HUNDRED THREE THOUSAND
DOLLARS ($403,000) FOR A TOTAL APPROPRIATION OF FIVE HUNDRED
9 SIX THOUSAND NINE HUNDRED EIGHTY-FOUR DOLLARS ($5.06,984) FOR
THE 1997-98 CDBG PROGRAM YEAR AND AUTHORIZING THE MAYOR TO

IMPLEMENT THE APPROVED PROGRAMS AND PROJECTS AS PROVIDED
]1 HEREIN.

]3 WHEREAS, the City Council of the City of Auburn must
]4 adopt and approve all appropriations by ordinance pursuant to
Chapter 35A RCW; and
]6
WHEREAS, according to RCW 35A.33.150 special fund
]7
18 appropriations do not lapse but carry forward from year to
]9 year until fully expended or the purpose has been accomplished
20 or abandoned without necessity of reappropriation; and
21
WHEREAS, it is in the best interest of the City of Auburn
22
and its citizens to amend Ordinances numbered 4845 and 4913 to
23
release certain unused specified funds appropriated therein

and to reappropriate those certain unused specified funds in

order to address current needs.
NOW THEREFORE THE CITY COUNCIL OF THE CITY OF AUBURN,

5 WASHINGTON, DOES HEREBY ORDAIN THE FOLLOWING:
6 S~CTTON 1. Amendment to Ordinance No. 4845.

Ordinance No. 4845 approved by the Auburn City Council on
8
April 15, 1996, and published April 24, 1996, is hereby
9
amended to release funds in the amount of Five Thousand
10
ll Dollars ($5,000.00) allocated to the Department of Planning
12 and Community Development for ~HUD Mandated Travel" as
13
provided in Exhibit "A" which was incorporated by reference in
14
Ordinance 4618 stating:
15
18 2. HUD Mandated Travel $5,000
17 Staff attendance at training for HUD's Integrated
18 Disbursement and Information System (IDIS) in
]9 Fairfax, Virginia. Attendance is strongly
recommended by HUD.

because the purpose for such funding has been abandoned,
21
creating the necessity for reappropriation, and to
22
reallocate the entire $5,000.00 for use in the 1997-98
23
CDBG program year.

Ordinance No. 4913 approved by the Auburn City Council on

October 7, 1996 and published October 13, 1976 is hereby

amended to release funds in the amount of Ninety Eight
8 Thousand Nine Hundred Eighty Four Dollars ($98,984.00)
7 allocated to Neighborhood Youth Centers as provided in Exhibit
8
"A" which was incorporated by reference in Ordinance 4913
9
stating:

Financial assistance to eligible agencies
13 in Auburn for building improvements
]4 necessary to accommodate and/or implement
15 the provision of youth activities and
16 programs.
17 because the purpose for such funding has been
18 abandoned, creating the necessity for
]9 reappropriation, and to reallocate the entire
20 $98,984.00 for use in the 1997-98 CDBG program year.

SRCTION 3. CDBG Budget for 1997-1998 Program Year.
The City Council of the City of Auburn hereby approves
3
the reappropriation of the amounts provided in Sections 1 and
4
5 2 and combines these aforementioned amounts with the City of
6 Auburn's 1997-98 CDBG entitlement of Four Hundred Three
7
Thousand Dollars ($403,000) to create a total ~997-98 CDBG
8
program budget of Five Hundred Six Thousand Nine Hundred
9
]0 Eighty Four Dollars ($506,984) for programs, projects and
11 administrative costs recommended by the Human Service
12 Committee and approved by the Planning and. Community
13
Development Committee for the 1997-98 CDBG program year.
14
Specific expenditures are itemized in Exhibit "A" which is
15
18 attached hereto and incorporated by reference herein.
17 Disbursement of CDBG funds for a specific program or project
]8
shall not exceed the amount appropriated, as indicated on the
19
itemized budget represented by Exhibit "A", for that
20
particular program or project.

S~CTTON 4. Prerequ.~ s.~ tes for Use of CDBG F~nds.
Grant recipients must certify that their planned use of

CDBG funds complies with the following:

5 (a) Compliance with national objectives.
6 Grant recipients must certify that their use of
7 CDBG funds give maximum feasible priority to
activities that benefit low and moderate income
8
residents or aid in the prevention or
9
elimination of sums or blight.
10
(b) Compliance w~th environmental review
11 procedures.
12 Grant recipients must certify their compliance
13 with environmental review procedures set forth
14 in 24 CFR, part 58, for each activity as
]5 applicable.

S~CTTON 5. ;,imitations on mxpend.~tures and

18 Adjustments.
19 No appropriation shall be made in excess of actual
20
revenues and no liability is to be incurred in excess of
21
appropriations. In the event that actual revenues are less
22
than or different than the revenues estimated by the CDBG
23
24 budget, the following actions shall be necessary and made:

(a) Public Service Programs:
2 In the event the City receives less than its
3 budgeted CDBG entitlement, each appropriation
4 for public services will receive a
5 proportionately equal reduction. in its
6 appropriation relative to the total decrease in
7 total revenues.

Appropriations for capital projects, including

the Housing Repair Program, shall be released
1] in accordance to their respective budget
]2 priority as provided in Exhibit "A".
13 Appropriations for each capital project shall
14 be released only when actual revenues are
15 sufficient to fully fund the appropriation
16 unless both the recipient Agency and the City
]7 mutually agree to a partial funding of the
]8 Agency's original appropriation. Partial
funding of an appropriation will release the
19
City from further obligations to fund that
20
particular appropriation and, thereby, allow
21 the City to consider funding either all or part
22 of the appropriation represented by the next
23 budget priority.

The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the

5 directives of this legislation.

7 SECTTON 7. Severability.
8 The provisions of this ordinance are declared to be
9 separate and severable. The invalidity of any clause,
10
sentence, paragraph, subdivision, section or portion of this
11
ordinance, or the invalidity of the application thereof to any
12
13 person or circumstance shall not affect the validity of the
]4 remainder of this ordinance, or the validity of its
15 application to other persons or circumstances.
SECTION 8. Effect.~ve Date:

This Ordinance shall be in force and take effect five (5)
]8
19 days from and after its passage, approval and publication, as
20 provided by law.

light fixtures, installation of new carpeting, repair outdoor decks, fire

4 Auburn Youth Resources: Building Improvements: $40,000
Expand the records storage area, enlarge the kitchen area to intclude a
small break room for staff members, and construct an entry ramp to
provide access to people with restricted mobility to their facility

4 Mental Health Housing Foundation: Housing Development: $5,860
Acquisition, relocation and miscellaneous development costs related to
purchasing an apartment building to provide affordable housing for

AMENDMENT TO PROJECT AGREEMENT
AUBURN HOUSING REPAIR PROGRAM
This Amendment entered into as of this 1st day of May, 1997, to that certain Block Grant Agreement,
#CD-260-76, dated February 22, 1977, between the King County Housing Authority and the City of Auburn, shall
amend the original Agreement as follows:
Provide a budget to operate the City's 1997 Housing Repair Program, BG-9706, to be budgeted as follows:
