HomeMy WebLinkAbout50651 ORDINA/qCE NO. 5 0 6 5 2 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, TO AMEND 3 ORDINANCE NUMBER 4738, WHICH APPROPRIATED COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS IN 1995, AND ORDINANCE 4 NUMBER 4845, WHICH APPROPRIATED CDBG FUNDS IN 1996, TO RELEASE CERTAIN UNUSED CDBG FUNDS IN ORDER TO REAPPROPRIATE SUCH FUNDS 5 FOR USE DURING THE 1998-99 CDBG PROGRAM YEAR, IN ADDITION TO THE CITY'S ENTITLEMENT FUNDS AND PROGRAM INCOME; AND TO 6 APPROPRIATE A TOTAL AMOUNT OF FOUR HUNDRED FIFTY THOUSAND, FOUR HUNDRED AND THREE DOLLARS ($450,403) FOR THE 1998-1999' 7 PROGRAM YEAR; AND TO AUTHORIZE THE MAYOR TO IMPLEMENT THE APPROVED PROGRAMS AND PROJECTS. 8 9 WHEREAS, the City Council of the City of Auburn must ]0 adopt and approve all appropriations by ordinance pursuant to ]] Chapter 35A RCW; and ]2 WHEREAS, according to RCW 35A.33.150 special fund 13 appropriations do not lapse but carry forward from year to ]4 year until fully expended or the purpose has been accomplished 15 or abandoned without necessity of reappropriation; and ]6 WHEREAS, it is in the best interest of the City of Auburn ]7 and its citizens to amend Ordinances numbered 473,B and 4845 to ]8 release certain unused specified funds appropriated therein 19 and to reappropriate those funds for the 1998-99 program year 20 in order to address current needs. 21 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: 24 25 Ordinance No. 5065 February 11, 1998 Page 1 1 Section 1. Amendment to Ordinance No. 4738 to reallocate a total of Fifteen Thousand Six Hundred and Seventeen Dollars ($15,617) to the 1998-99 Program Year. 4 5 Ordinance No. 4738, approved by the Auburn City Council 6 on April 3, 1995 and published April 9, 1995, is hereby 7 amended to release funds in the amount of Fifteen Thousand Six 8 Hundred and Seventeen Dollars ($15,617) out of the total 9 Forty-Six Thousand Four Hundred and Sixty Dollars ($46,460) 10 allocated to 1995 Program Administration, as provided for in 11 Exhibit "A" which was incorporated by reference into Ordinance 12 No. 4738, and to reallocate and reappropriate the unused 13 balance for expenditure in the 1998-99 CDBG program year. 14 Section 2. Amendment to Ordinance No. 4845. ]5 Ordinance No. 4845 approved by the Auburn City Council on 17 April 15, 1996, and published,~F~'/~~/~;~ e-ge6, as amended by Ordinance No. 4913 on October 2, 1996, is hereby amended to ]8 release funds in the amounts of Thirty-Two Thousand, Five ]9 Hundred Dollars ($32,500) and Three Thousand, TwO Hundred 20 21 Eighty-Six Dollars ($3,286) for a total amount of Thirty-Five 22 Thousand, Seven Hundred and Eighty-six Dollars ($35,786) which 23 was allocated to the Department of Planning and Community 24 Development for Capital Improvements as provided in Exhibit 25 "A", which was incorporated by reference in Ordinance No. 26 Ordinance No. 5065 February 11, 1998 Page 2 ] 4913. Section 4 of Exhibit "A" of Ordinance No. 4913 2 provides: "4. Auburn Community Health Center: Roof Replacement: 4 $32,500 5 Rebuild and/or replace the roof of the Au]ourn Community Health Center located at 105 "A" Street S.E., Auburn." 7 The funding was not used, creating the necessity for 8 reappropriation, and reallocation of the entire $32,500 for 9 use in the 1998-99 CDBG program year. Section 7 of Exhibit ]0 ~A" of Ordinance No. 4913 provides: ]! ]2 "7. Valley Cities: Handicap Accessibility: $37,850 ]3 Install fixtures and make the building modifications ]4 necessary to provide accessibility to handicapped individuals ]5 who enter the Valley Cities Counseling and Consultation Center ]6 located at 2704 "I~ Street N.Eo, Auburn." 17 The Valley Cities: Handicap Accessibility funding was not 18 completely used, creating the necessity for reappropriation, 19 and reallocation of the balance of Three Thousand,, Two Hundred 20 and Eighty Six Dollars ($3,286) of said funds for use in the 2] 1998-99 CDBG program year. 22 Section 3. CDBG Budqet for 1998-1999 Program Year. 23 The City Council of the City of Auburn hereby approves 24 the reappropriation of the amounts provided in Sections 1 and 25 26 Ordinance No. 5065 February 11, 1998 Page 3 1 2 hereof and combines these aforementioned amcunts, totaling 2 Fifty-One Thousand, Four Hundred Three Dollars ($51,403) with 3 the City of Auburn's 1998-99 CDBG entitlement of Three Hundred 4 Eighty-Nine Thousand Dollars ($389,000), and Ten Thousand 5 Dollars ($10,000) received as program income in 1997, for a 6 combined 1998-99 CDBG program budget of Four Hundred Fifty 7 Thousand Four Hundred and Three Dollars ($450,403) for 8 programs, projects, and administrative costs recommended by 9 the Human Service Committee and approved by the Planning and ]0 Community Development Committee for the 1998-99 CDBG program 11 year. Specific expenditures for the 1998-99 Program Year are 12 itemized in Exhibit ~A", attached hereto and incorporated herein by this reference. Disbursement of CDBG funds for a ]4 specific program or project shall not exceedl the amount 15 appropriated, as indicated on the itemized budget set forth in 16 Exhibit "A", to this Ordinance No. 5065 for that particular program or project. ]8 Section 4. Prerequisites for Use of CDBG Fu~ds. ]9 20 Grant recipients must certify that their planned use of 21 CDBG funds complies with the following: 22 (a) Compliance with national obiectives. 23 Grant recipients must certify that their' use of CDBG 24 funds gives maximum feasible priority to activities that 25 26 Ordinance No. 5065 February 11, 1998 Page 4 1 benefit low and moderate income residents or aid in the 2 prevention or elimination of sums or blight. 3 (b) Compliance with environmental review mrocedures. 4 Grant recipients must certify their compliance with 5 environmental review procedures set forth in 24 CFR, part 6 58, for each activity as applicable. ? Section 5. Limitations on Expenditures and Adiustments. 8 No appropriation shall be made in excess of actual revenues and no liability is to be incurred in excess of 10 appropriations. In the event that actual revenues are less than or different than the revenues estimated by the CDBG 12 budget, the following actions shall be taken: (a) Public Service Proqrams: 14 In the event the City receives less than its budgeted CDBG entitlement, each appropriation for public services will receive a proportionately equal reduction in its 17 appropriation relative to the total decrease in total 18 revenues. (b) Neiqhborhood Revitalization and Public ]Facilities: 20 Appropriations for capital projects, including the 21 Housing Repair Program, shall be released in accordance to 22 their respective budget priority as provided in Exhibit "A" as 23 set forth above. Appropriations for each capital project shall 24 be released only when actual revenues are sufficient to fully Ordinance No. 5065 February 11, 1998 Page 5 1 fund the appropriation unless both the recipient Agency and 2 the City mutually agree to a partial funding of the Agency's 3 original appropriation. Partial funding of an appropriation 4 will release the City from further obligations to fund that 5 particular appropriation and, thereby, allow the City to 6 consider funding either all or part of the appropriation 7 represented by the next budget priority. 8 Section 6. Implementation. 9 The Mayor is hereby authorized to implement such 10 administrative procedures as may be necessary to carry out the ]1 directives of this legislation. ]2 Section 7. Severability. 13 The provisions of this Ordinance are declared to be 14 separate and severable. The invalidity of any clause, ]5 sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any 17 person or circumstance shall not affect the validity of the ]8 remainder of this Ordinance, or the validity of its ]9 application to other persons or circumstances. 20 Section 8. The 12 units, located at 606-640 "L" Place SE in Auburn, are leased to the YWCA for emergency and transitional housing and to 9 Northwest Mental Health Services for supportive housing. {CDBG 10 eligible under 24CFR570.202} Eiderhealth Northwest Connection, Buildin~ Renovation: $10,000 11 Funds to be used in the renovation of the Connection building: at 3921 12 Talbot Road South in Renton.
