AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE ACCEPTANCE OF A GRANT FROM THE
TRANSPORTATION IMPROVEMENT BOARD FOR THE CONSTRUCTION OF
PEDESTRIAN PUSHBUTTONS IN THE CENTRAL BUSINESS DISTRICT.
WHEREAS, the City Council of the City of Auburn must
adopt and approve all appropriations by Ordinance pursuant to
Chapter 35A.33 RCW; and
NOW, THEREFORE, THE CITY COUNCIL
WASHINGTON, DO ORDAIN AS FOLLOWS:
OF THE CITY OF AUBURN,
Section 1. Pursuant to Chapter 35A.33 RCW, the City
Council hereby approves expenditure and appropriation of a
grant from the Transportation Improvement Board {TIB) which
will be used for the construction of pedestrian pushbuttons in
the Central Business District (CBD), in the amount of $64,000
with $16,000 in matching funds from the City 102 Gas Fund and
authorizes the Mayor to execute a Pedestrian Facility Program
Design and Construction Prospectus between the City and the
Transportation Improvement Board, a copy of which is attached
hereto as Exhibit

Auburn's recent downtown revitalization program has increased both motorized and non-motorized traffic. Of the
twelve signalized intersections, nine signals are proposed for upgrade. Currently, signals are pre-timed and run
less efficiently than they could due to long pedestrian clearance times that are required for the minor streets.
Installation of pedestrian pushbuttons will enable adjustment of cycle times, eliminate the unnecessary service of
the "walk" and "don't walk" every cycle, and allow the pedestrian to have some control over the "walk" signal.
These improvements, in turn, will help provide for a more efficient movement of pedestrians and vehicles.
Design will be completed by May of 1998, with advertisement for bids in June 1998, and project completed
September 1998.

Certification is hereby given that Local and/or Private Matching Funds and Other Funds
associated with the total project are available to coordinate with the proposed project
development.
This project t~as been reviewed by the Legislative Body of the Administering Agency or
agencies or its Designee, and is consistent with the Agency Comprehensive Plan for the
Community Development.
If required, an Environmental Impact Analysis has been conducted. An Environmental Impact
Statement or Negative Declaration of Environmental Impact, as appropriate, has been
circulated pursuant to RCW 42.210. The results have been utilized in arriving at the decisions
reflected in the prospectus.
A public involvement process was used by the Agency or its designee during development of
the project. It includes meaningful citizen participation at all phases of the project.
All right of way required for the project is available. All right of way for this project has been
acquired in accordance with WAC chapter 468-100.
If the project is located in or affecting a non-attainment area, the Lead Agency certifies
compliance with all requirements of the State & Federal Clean Air Acts.

IN CONSIDERATION of the allocation by the Transportation Improvement Board of TIA matching funds to the
project and in the amount set out above, the agency hereby agrees that as condition precedent to payment of
any TIA matching funds allocated at any time to the above referenced project, it accepts and will comply with the
terms of this agreement, including the terms and conditions set forth in RCW 47.26; the applicable rules and
regulations of the Transportation Improvement Board, and all representations made to the Transportation
Improvement Board upon which the fund allocation was based; all of which are familiar to and within the
knowledge of the agency and incorporated herein and made a part of this agreement, although not attached.
The officer of the agency, by the signature below hereby certifies on behalf of the agency that federal, state, and
local funds represented to be committed to the project will be available as necessary to implement the projected
development of the project as set forth in the TIB Prospectus, acknowledges that funds hereby authorized are
for the development of the design and construction proposal as defined by Chapter 167, Laws of 1988.
Projects in clean air non-attainment areas are subject to air quality conformity requirements as specified in RCW
70.94. The lead agency certifies that the project meets all applicable Clean Air Act requirements.
IN CONSIDERATION of the promises and performance of the stated conditions by the agency, the
Transportation Improvement Board hereby agrees to reimburse the agency from TIA matching funds allocated,
and not otherwise, for its reimbursable costs not to exceed the amount specified. Such obligation to reimburse
TIA matching funds extends only to project costs incurred after the date of the Board's allocation of funds and
authorization to proceed with the project.
