HomeMy WebLinkAbout5069 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 5 0 6 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE CONVERSION TO, AND SALE OF AUBURN POLICE CANINE AX VON DER HENGELEDRE AS SURPLUS PERSONAL PROPERTY OWNED BY THE CITY OF AUBURN AS AUTHORIZED BY RCW 35A.79.010 ENTITLED POWERS TO ACQUIRE, USE AND MANAGE AND AS AUTHORIZED BY RCW 35A.11.020 ENTITLED POWERS VESTED IN LEGISLATIVE BODIES OF NONCHARTER AND CHARTER CODE CITIES. WHEREAS, RCW 35A.79.010 entitled "Powers and manage" provides that a code dispose of municipal property, WHEREAS, RCW 35A.11.020 legislative bodies provides that any code city may exercise to acquire, use city shall have the power to both real and personal; and entitled "Powers vested in of noncharter and charter code cities" its powers in regard to the sale of personal property; and WHEREAS, the City of Auburn Police Canine Ax Von Der Hengelbdre has suffered a career ending injury; and WHEREAS, City of Auburn Police Canine who has been the Officer exclusively for Police Ryan Worthington, Handling Officer Hengelbdre to acquire Hengelbdre. RCW 35A.79.010 property. Section 2. The City of Auburn Police Depaztment having determined that Canine Ax Von Der Hengelbdre has suffered a career ending injury has therefore determined to convert the property status of said canine to surplus property and to sell said canine to Auburn Police Officer Ryan Worthington for the amount of one-dollar ($1.00) and execution of sale and waiver agreement as described in Exhibit A attached hereto and incorporated herein by this reference. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the direction of this legislation. Section 6. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. I, Ryan Worthington, understand that I am receiving full ownership of this Police Canine, that the City of Auburn is relinquishing all claims to this Police Canine, and that from the time of execution of this agreement forward, I Ryan Worthington assume total responsibility for the care, maintenance and actions of this Police Canine. I, Ryan Worthington, further acknowledge that I have been the handler for this Police Canine from the beginning of this Police Canine's Police training in 1993 and for the duration of this Police Canine's career as a Canine Officer with the City of Auburn Police Department. As exclusive handler of this Police Canine, I have special knowledge regarding the level of Police Canine training and behavioral attributes of this Canine, both from the Police Canine training and the aggressive traits of the Rottweiler breed of canine. I, Ryan Worthington, for and in consideration of being sold the above named Police Canine by the City of Auburn, with the City of Auburn relinquishing all claims to this Police Canine do for myself, heirs, successors and assigns do agree to defend, indemnify and hold the City of Auburn harmless from and against any and all claims, injuries, damages, losses or suits of any nature whatsoever, including but not limited to attorney fees arising out of or in any connection with my use of this Police Canine for the duration of this Canine's life.
