HomeMy WebLinkAbout5212 ORDINANCE NO. 5 2 1 2 2 $ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING CHAPTERS 1.04 ENTITLED "GENERAL 4 PROVISIONS," 1.25 ENTITLED "CIVIL PENALTIES FOR VIOLATIONS," 8.04 ENTITLED "FOOD ESTABLISHMENTS," 8.08 ENTITLED "SOLID 5 WASTE," 10.12 ENTITLED "TRAFFIC REGULATIONS," 10.36 ENTITLED "STOPPING, STANDING AND PARKING," 12.48 ENTITLED, "STREET VACATIONS," 13.08 ENTITLED ~WATER MAIN EXTENSIONS," 13.20 ENTITLED "SEWERS," 13.48 ENTITLED ~'STORM DRAINAGE UTILITY," ? 15.08 ENTITLED "BUILDING CODE," 15.36 ENTITLED, "FIRE CODE," AND 15.76 ENTITLED "HISTORIC PRESERVATION" AND TO INCORPORATE $ THE CHANGES IN THESE CHAPTERS OF THE CITY CODE FOR PURPOSES OF INCORPORATING THE PROPERTIES IN PIERCE COUNTY WHICH WERE 9 INCORPORATED INTO THE CITY OF AUBURN BY ANNEXATION EFFECTIVE MAY 13, 1998 AND TO REVISE CHAPTER 12.48 ENTITLED "STREET 10 VACATIONS" TO MAKE IT CONSISTENT WITH CITY PRACTICES AND 11 PROCEDURES, AND TO REVISE CHAPTER 13.48 ENTITLED "STORM DRAINAGE UTILITY" TO SET FORTH PROCEDURES FOR ADMINISTRATIVE 12 REVIEW OF DISPUTED STORM DRAINAGE CHARGES. 15 WHEREAS, changes to the Auburn City Code are necessary 14 for purposes of incorporating the properties in Pierce County 15 which were incorporated into the City of Auburn by annexation 16 effective May 13, 1998 as authorized by City of Auburn 17 18 Ordinance No. 5089. ]9 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 20 WASHINGTON, DO ORDAIN AS FOLLOWS: 2! Section 1. PURPOSE: The purpose of this ordinance is as 22 follows: 23 To amend Chapter 1.04 "General Provisions" of the Auburn City Code as set forth in Exhibit "A" attached hereto and 25 26 ~d~ce No. 5212 J~uary 22, 1999 Page 1 1 incorporated herein by this reference to re-define "County" 2 due to extension of the City's current regulations into Pierce County consistent with the annexation. 4 To amend Chapter 1.25 "Civil Penalties or Violations" of 5 the Auburn City Code as set forth in Exhibit "B" attached hereto and incorporated herein by this reference to extend the 7 City's current regulations into Pierce County consistent with 8 the annexation. 9 To amend Chapter 8.04 "Food Establishments" of the Auburn ]O City Code as set forth in Exhibit "C" attached hereto and incorporated herein by this reference to extend the City's current regulations into Pierce County consistent with the 14 annexation. 15 To amend Chapter 8.08 "Solid Waste" of the Auburn City Code as set forth in Exhibit "D" attached hereto and ]7 incorporated herein by this reference to extend the City's ]8 current regulations into Pierce County consistent with the 19 annexation. 20 To amend Chapter 10.12 "Traffic Regulations" of the Auburn City Code as set forth in Exhibit "E" attached hereto 22 and incorporated herein by this reference to extend the City's 23 current regulations into Pierce County consistent with the 24 25 Ordin~¢¢ No. 52 ]2 3~uary 22, 1999 Page 2 ! annexation. 2 To amend Chapter 10.36 "Stopping, Standing and Parking" of the Auburn City Code as set forth in Exhibit "F" attached 4 hereto and incorporated herein by this reference to extend the 5 City's current regulations into Pierce County consistent with the annexation. 7 To amend Chapter 12.48 "Street Vacations" of the Auburn 8 City Code as set forth in Exhibit "G" attached hereto and 9 incorporated herein by this reference to extend the City's current regulations into Pierce County consistent with the 12 annexation and to make it consistent with City practices and 13 procedures. 14 To amend Chapter 13.08 "Water Main Extensions" of the 15 Auburn City Code as set forth in Exhibit "H" attached hereto and incorporated herein by this reference to extend the City's 17 current regulations into Pierce County consistent with the 18 annexation. To amend Chapter 13.20 "Sewers" of the Auburn City Code 2O as set forth in Exhibit "I" attached hereto and incorporated 21 herein by this reference to extend the City's current 22 regulations into Pierce County consistent with the annexation. 24 To amend Chapter 13.48 "Storm Drainage Utility" of the 25 Ord~¢e No. 5212 J~uary 22, 1999 Page 3 Auburn City Code as set forth in Exhibit "J" attached hereto 2 and incorporated herein by this reference to extend the City's 3 current regulations into Pierce County consistent with the 4 annexation and to set forth procedures for administrative 5 review of disputed storm drainage charges. To amend Chapter 15.08 "Building Code" of the Auburn City 7 Code as set forth in Exhibit "K" attached hereto and 8 incorporated herein by this reference to extend the City's 9 current regulations into Pierce County consistent with the 11 annexation. 12 To amend Chapter 15.36 "Fire Code" of the Auburn City 13 Code as set forth in Exhibit "L" attached hereto and 14 incorporated herein by this reference to extend the City's current regulations into Pierce County consistent with the annexation. 17 To amend Chapter 15.76 "Historic Preservation" of the Auburn City Code as set forth in Exhibit "M" attached hereto 19 and incorporated herein by this reference to extend the City's 20 current regulations into Pierce County consistent with the 21 annexation. 22 Section 2. CONSTITUTIONALITY OR INVALIDITY: If any 24 section, subsection, clause, phrase, or sentence, of this 25 26 Ord~¢¢ No. 5212 3~u~ry 22~ 1999 Page 4 ] Ordinance, is for any reason held to be invalid or 2 unconstitutional, such invalidity or unconstitutionality of $ the remaining portions of this ordinance, as it is being 4 hereby expressly declared that this ordinance and each 5 section, subsection, clause, phrase, or sentence, hereof would have been prepared, proposed, adopted, and approved and 7 ratified irrespective of the fact that any one or more 8 section, subsection, clause, phrase, or sentence, be declared 9 invalid or unconstitutional. 10 11 Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. 14 Section 4.
