HomeMy WebLinkAbout52221 ORDINANCE NO. 5 2 2 2 2 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING CHAPTERS 2.27 ENTITLED ~PUBLIC WORKS 4 DEPARTMENT", 13.20 ENTITLED ~SEWERS", AND 13.48 ENTITLED 5 "STORM DRAINAGE UTILITY" AND TO INCORPORATE THE CHANGES IN THIS CHAPTER OF THE CITY CODE TO REFLECT CURRENT EMPLOYEE AND 6 DIVISION TITLES AND RESPONSIBILITIES. 7 8 WHEREAS, the City desires to update City Code Chapters 9 2.27, 13.20, and 13.48 to reflect current employee and 10 division titles and responsibilities; 1] NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 12 WASHINGTON, DO ORDAIN AS FOLLOWS: 14 Section 1. ITY OR INVALID.TTY: If any 7 section, subsection, clause, phrase, or sentence, of this 8 Ordinance, is for any reason held to be invalid or 9 unconstitutional, such invalidity or unconstitutionality of ]0 the remaining portions of this ordinance, as it is being l] 12 hereby expressly declared that this ordinance and each 13 section, subsection, clause, phrase, or sentence, hereof would 14 have been prepared, proposed, adopted, and approved and ]5 ratified irrespective of the fact that any one or more 17 section, subsection, clause, phrase, or sentence, be declared 18 invalid or unconstitutional. 19 Section 3. There is created an administrative department of the city known as the public works department, which shall be under the supervision of the director of enginocring and public works. (1957 code § 1.17.010.) 2.27.020 Duties. The department of public works shall have supervision and control of: A. The construction, operation and maintenance of all public streets, sidewalks, alleys, bridges, viaducts, highways and rights-of-way, including the placement and operation of signs, signals and lighting fixtures; B. The construction, operation and maintenance of all public water supply, storage and distribution facilities, including water mains, pumping stations, reservoirs, wells and headworks; C. The construction, operation and maintenance of all sanitary sewers, sewer facilities and appurtenances, including sanitary sewers, pumping stations and sewage treatment facilities; D. The construction and maintenance of all storm sewer facilities and appurtenances, including storm sewers, drains, ditches, culverts and streams and watercourses under jurisdiction of the city; E. The construction, maintenance and operation of all public parking lots; F. The collection and disposal of all refuse, garbage, rubbish, swill and the cleaning of all streets and alleys including snow removal operations; G. The administration and supervision of all building~ and plumbing, electrical, housing and zoning ordinances and codes; H. The control, management and supervision of the equipment rental fund, including all associated city shops and garages; I. The making of all necessary surveys, maps, drawings and documents and the preparation of contract drawings, specifications, cost estimates, supervision of construction and inspection for all public works construction; J. Other duties, as may be assigned by the city council from time to time. (1957 code § 1..17.020.) The cleaning and maintenance of certain public buildings. 2.27.030 Divisions. The department shall consist of six or more ~even divisions as follows: A. The division of engineering shall be responsible for all engineering services, including the design and preparation of all contract drawings and specifications for all public work contracts, the preparation of cost estimates, setting the line and grades for all such construction, the supervision and inspection of all such construction, the establishment of all street, alley and walk grades, all city surveying and mapping operations, maintenance of street, water, sewer and storm sewer utility records, review of all subdivision plats for matters requiring engineering determination, processing of all local improvement districts and design of channelization and traffic-control devices. B. The water division shall be responsible for the management, operation and maintenance of all public water supply, storage and distribution facilities. C. The sewedstorm division shall be responsible for the management, operation and maintenance of all sanitary sewers, appurtenances, pumping stations and all treatment plant facilities~, including maintenance of all storm sewers and appurtenances. D. The street division shall be responsible for the maintenance of all streets, highways, walks, pavements, surfaces, including maintonance of all storm scwors and 3ppurtonancos, street cleaning, street repair, snow and ice removal. E. The sanitation solid waste division shall be responsible for recycling and the collection and disposal of garbage, rubbish and other wastes. F. The equipment rental division shall be responsible for the management, supervision, servicing and maintenance and repair of all-certain municipal motor equipment. The building division shall be responsible for the administration and supervision of all building and plumbing codes: code enforcement: and maintenance of certain public buildings. 2.27.040 Composition. (1957 code § 1.17.040.) 2.27.050 Supervisory personnel - Appointments - Removals. The director of engineering and public work~ and city engineer, assistant city engineer and superintendent of public works shall he appointed by the mayor upon approval of the city council. The water supervisor, sewer supervisor, street supervisor, sanitation supor,visor and equipment rental supervisor shall be appointed by the dirootor of engineering and public works following recommendation by the superintendent of public works. The salaries of the administrative and supervisory personnel in the department of public works shall be as determined and fixed in the annual budget of the city. Unless the context specifically indicates otherwise, the meaning of the terms used in this chapter shall be as follows: A. "BOD" (denoting biochemical oxygen demand) means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20 degrees centigrade expressed in parts per million by weight. B. "Building sewer' means that part of the lowest horizontal piping of the building sewer system which receives the discharge from drainage pipes inside the walls of the building and conveys it to the side sewer. C. "Charge in lieu of assessment" means a charge made by the city on property which has not previously participated in the cost of a public sewer line directly serving the property. D. "City engineer' means the division head of engineering for the city, or his authorized representative. E. "Combined sewer' means a sewer receiving both storm water runoff and sewage. F. "Commercial services" means sewer service to multiple dwelling units (as defined hereinafter) or businesses engaged in manufacturing and/or sale of a commodity or commodities, or rendering of a service such as, but not limited to, hotels, motels, hospitals, industrial complexes, schools and colleges, convalescent homes, nursing homes, and retirement homes. G. "Dwelling unit" means one or more rooms designed for or occupied by one family for living or sleeping purposes and containing kitchen facilities for use solely by one family. H. "Latecomer connection charge" means a charge made on property which has not previously participated in the cost of a public sewer line, directly serving the property, for the purpose of reimbursing a property owner who installed the sewer line. "Multiple dwelling units" means two or more residential units connected to a single water service. ,KJ. "Natural outlet" means any outlet (conveyance) into a watercourse, pond, ditch, lake, or other body of surface or ground water. I=K. "pH" means the measurement of acidity or alkalinity of sewage and is measured as the logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution. ML. "Premises" means property, including improvements, utilized under one ownership and/or under a single entity control with respect to the use of sewer services and the responsibility for payment thereof. NM. "Properly shredded wastes" means the wastes from the preparation, cooking and dispensing of food that have been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half inch in any dimension. ON. "Public sewer" means a sewage conveyance facility which is owned, maintained and controlled by public authority. P_O. "Public works director" means the department head of public works for the city, or his authorized representative. QP. "Sanitary sewer" means a wastewater conveyance facility to which storm, surface, and ground water are excluded. RQ. "Sewage" means residential, business, industrial, and institutional wastewater. S_R. "Sewer" means a facility for conveying sewage. -,1:S. "Sewerage" means all facilities for collecting, transporting, pumping, treating, and disposing of sewage. UT. "Side sewer" means the extension from the building sewer to the tee or wye connector on the public sewer. ~r~/_. "Storm drain" means a wastewater conveyance facility for storm, surface, and ground water. · ~W. "Suspended solids" means solids that float on the surface of, or are in suspension in, water, sewage, or other liquids, and which are removable by laboratory filtering. ¥X. "Trunkage connection charge" means an indirect charge for extra capacity facilities not constructed with SDC moneys. ,7__y. "Watercourse" means a channel, either natural or manmade, in which a flow of water occurs, either continuously or intermittently. (Ord. 4241 § 2, 1987.) 13.20,020 Sewer section - Established. The sewer section of the maintenance and operations division of the public works department is established. (Ord. 4241 § 2, 1987. ) 13.20.050 Developer extension agreement - Required - Manual adopted. There is adopted by reference the "Developer's Public Facility Extension Manual for Sanitary Sewers, Water, Storm Sewers and Streets," a copy of which is attached to the ordinance codified in this chapter and denominated Exhibit "A." (Ord. 4241 § 2, 1987.) 13.20.060 Connection - Required. Whenever a house, building or other type of dwelling used for human occupancy, within or without the city limits abuts any street, alley or easement containing a public sanitary sewer of the city, and where any portion of the house, building or other type of dwelling used for human occupancy is situated within 330 feet of said street, alley or easement containing said public sanitary sewer line, the property owner shall connect to the available sewer line within 90 days from the date the sewer becomes available for service in accordance with the provisions of ACC 13.20.070. The ordinance codi~ed in this section is passed pursuant to the last paragraph of RCW 35.67.190. (Ord. 4241 § 2, 1987.) 13.20.070 Compulsory connections. If any owner fails through neglect or refusal to connect lands, buildings or other premises with the Aubum public sewer as required by ACC 13.20.060, or fails through neglect or refusal to do other work specified or ordered to be done as provided by this chapter within the time specified, a monthly rate shall be charged in accordance with the rate structure identified in ACC 13.20.440, regardless of hookup to the available sewer. At such time as an owners septic tank, drainfield or other private sewage disposal system becomes inoperable in accordance with the provisions of the Seattle-King County Health Department, and is thereby refused a permit to make it operable the facility served by the failed system shall be required to connect to an available sewer in order to be habitable. (Ord. 4241 § 2, 1987.) 13.20.080 Private system - Allowed when. Where a public sewer is not available within 330 feet, a private sewer system and sewage disposal system may be installed in accordance with the provisions of the Seattle/King County Health Department. The responsibility for the maintenance and operation of the storm drainage utility system shall be by the public works opor3tions m3nagor sewer/storm division supervisor, in such manner as the city council shall provide.
