HomeMy WebLinkAbout5347 ORDINANCE NO. 5 3 4 7' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE TWO PREANNEXATION AGREEMENTS WITH PIERCE COUNTY RELATING TO COST SHARING THE CONSTRUCTION OF THREE SIGNALIZED INTERSECTIONS. WHEREAS, this agreement, made pursuant to RCW Chapter 39.34, is made and entered into this 7th day of FebD_,ary ,2000, by and between Pierce County (hereinafter, the County) a political subdivision of the State of Washington, and the City of Auburn (hereinafter, the City), a municipal subdivision of the State of Washington; and WHEREAS, the City has begun the phased annexation of a portion of unincorporated Pierce County in Sections 5 and 6, Township 20 North, Range 5 East, Willamette Meridian (hereinafter, the annexation area); and WHEREAS, the Pierce County Council adopted the Pierce County Transportation Plan in December 1992 by passage of Ordinance 92-147, to identify transportation needs and services throughout the County, and the Transportation Plan recommends new arterial connections in the North Lake Tapps area as "Premier Priority Projects;" and WHEREAS, the Pierce County Council established the North Lake Tapps Corridor (hereinafter, the Corridor) in June 1994 by passage of Ordinance No. 5347 02/03100 Page 1 Ordinance 94-73, thereby establishing a new County arterial and connecting roads from 8"' Street East in the vicinity of the White River Bridge No. 1204-A, to 9th Street East, in the Vicinity of 182"d Avenue East; and WHEREAS, the City of Auburn adopted a map detailing its Potential Annexation Areas/Urban Growth Areas in 1991 and reconfirmed these boundaries in its 1995 Growth Management Act Comprehensive Plan; and WHEREAS, preliminary engineering (PE) and construction is currently underway for projects along 8th Street East and the Lake Tapps Parkway East corridor; and WHEREAS, the County and the City find it in the public interest to coordinate their efforts in a cooperative partnership to insure the orderly and consistent construction, maintenance, and use of the regional infrastructure and facilities as stated herein. Ordinance No. 5347 02/03/00 Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Mayor and City Clerk of the City of Auburn are authorized to execute two preannexation agreements relating to cost sharing the construction of three signalized intersections. A copy of said Agreements are attached hereto and designated Exhibits "A" and "B" and incorporated by reference herein. Section 2. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 3. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. It is agreed that this work will be done at the convenience of the Public Works and Utilities Department and that the undersigned agency or department will reimburse Pierce County for all costs incurred. The undersigned agency certifies that it is authorized by law to perform the governmental work or service specified below and is authorized to enter into this contxact. Description of work or services requested: Provide civil engineering services for the redesign of the traffic signal plans for the proposed intersection of Lakeland Hills Way and Lake Tapps Parkway to accommodate conversion of the current County's standard "span- wire" design to the City's standard "mast-arm" design. together with the increased incremental construction cost between the two designs. The lump sum cost shall include all redesign, repackaging the plans and specifications, construction inspection/engineering, the incremental cost increase between the County design and the additional construction elements to accommodate Auburn standards, and other related services. · ard, P.E., County Engineer in Public Works and Utilities Department. Each party to this agreement shall save the other harmless from any loss or damage to the property of the other or from claim of third parties caused by any acts or omissions, negligence of said party, its elected or appointed officials, its agents or employees relating to the work proposed in this agreement to the fullest extent allowed by law. The Undersigned certifies that sufficient budgeted funds are available to cover the cost of the requested work or services, and agrees to make payment to the Pierce County Road Fund as follows: The lump sum redesign costs of $16,000.00 will be paid within ten riO) days after the signing of this agreement. The lump sum construction related costs of $14,000.00 will be paid within ten (10) days after award of the construction contract containing the traffic signal for the intersection of Lakeland Hills Way and Lake Tapps Parkway. The undersigned further certifies that quotations or bids for performing the requested services or work have not been solicited from any other public agency nor from any private individual, company, or corporation.
