HomeMy WebLinkAbout5354 ORDINANCE NO. 5 3 5 4 ] AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, 2 WASHINGTON, AMENDING AUBURN CITY CODE SECTION 18.02.050 ENTITLED "ZONING FOR ANNEXED LAND" CONTAINED IN CHAPTER 18.02 3 ENTITLED "GENERAL PROVISIONS" WHICH AMENDMENT WILL CONTINUE TO ALLOW FOR ANNEXATION WITHOUT CONCURRENT ZONING BUT THE EFFECTIVE ZONING FOR ANY LEA HILL AREA ANNEXED WOULD BE LHR1 5 WHICH REFLECTS THE NEWLY ADOPTED LEA HILL ZONING DISTRICTS; AUBURN CITY CODE SECTION 18.06.010 ENTITLED "DISTRICTS 6 DESIGNATED" CONTAINED IN CHAPTER 18.06 ENTITLED "DISTRICTS AND MAPS" BY ADDING A NEW SUBSECTION 18.06.010(A)(20) WHICH LISTS 7 THE NEW LEA HILL ZONING DISTRICTS; AND ADDING A NEW AUBURN CITY CODE SECTION 18.04.522 ENTITLED "LEA HILL AREA" CONTAINED IN 8 CHAPTER 18.04 ENTITLED "DEFINITIONS" WHICH ADDS A DEFINITION OF 9 THE "LEA HILL AREA". 10 ]:1 WHEREAS, Auburn City Code Section 18.02.050 entitled "Zoning for :12 Annexed Land" contained in Chapter 18.02 entitled "General Provisions" 13 provides that property not zoned concurrent with annexation will assume the R-l, Single Family zoning upon the effective date of annexation; and ].5 ]6 WHEREAS, since the City has adopted new zoning districts for the Lea ]7 Hill area, it is desirable to amend ACC 18.02.050 so that annexations can 18 continue without concurrent zoning but provide that any Lea Hill annexations ]9 would be LHR1 which reflects the newly adopted Lea Hill zoning districts; and 20 WHEREAS, Auburn City Code Section 18.06.010 entitled "Districts 21 Designated" contained in Chapter 18.06 entitled "Districts and Maps" includes 22 districts designated by the City; and 23 25 26 Ordinance No. 5354 03/02/00 Page 1 1 WHEREAS, since the new Lea Hill zoning districts need to be included in 2 Chapter 18.06, it is necessary to add a new subsection 18.06.010(A)(20) to 3 provide for the new Lea Hill zoning districts; and 4 WHEREAS, it is necessary to amend Auburn City Code Chapter 18.04 5 entitled "Definitions" by adding a new Section 18.04.522 entitled "Lea Hill Area" 6 to provide a definition for the Lea Hill area; ? 8 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 9 WASHINGTON, DO ORDAIN AS FOLLOWS: 10 Section 1. PURPOSE: The purpose of this ordinance is to amend 11 Auburn City Code Section 18.02.050 entitled "Zoning for Annexed Land" 12 contained in Chapter 18.02 entitled "General Provisions" which amendment will 13 continue to allow for annexation without concurrent zoning but the effective lz~ zoning for any Lea Hill Area annexed would be LHR1 which reflects the newly 15 16 adopted Lea Hill zoning districts; to amend Auburn City Code Section 18.06.010 17 entitled "Districts Designated" contained in Chapter 18.06 entitled "Districts and 18 Maps" by adding a new subsection 18.06.010(A)(20) which lists the new Lea Hill 19 zoning districts; and to add .a new Auburn City Code Section 18.04.522 entitled 20 "Lea Hill Area" contained in Chapter 18.04 entitled "Definitions" which adds a 21 definition of the "Lea Hill Area". 22 23 24 25 26 Ordinance No. 5354 03/02/00 Page 2 1 2 Section 2. ADOPTION. The Auburn City Council does hereby approve 3 the amendments to Auburn City Code Section 18.02.050 entitled "Zoning for Annexed Land", to Auburn City Code Section 18.06.010 entitled "Districts 5 Designated" and to Auburn City Code Chapter 18.04 entitled "Definitions" by 6 adding a new section 18.04.522 as provided in the attached Exhibit "A" which is ? 8 by this reference incorporated herein as if fully set forth. 9 Section 3. CONSTITUTIONALITY OR INVALIDITY: If any section, 10 subsection, clause, phrase, or sentence, of this Ordinance, is for any reason ] 1 held to be invalid or unconstitutional, such invalidity or unconstitutionality of the 12 remaining portions of this ordinance, as it is being hereby expressly declared that 13 this ordinance and each section, subsection, clause, phrase, or sentence, hereof would have been prepared, proposed, adopted, and approved and ratified 15 16 irrespective of the fact that any one or more section, subsection, clause, phrase, ]7 or sentence, be declared invalid or unconstitutional. 18 Section 4. The Mayor is hereby authorized to implement such 19 administrative procedures as may be necessary to carry out the directions of this 20 legislation. 21 Section 5. Prior to any parcel of land being annexed to the city, the property may be zoned consistent with the Auburn zoning districts and the comprehensive plan amended if necessary. Application for the fezone and necessary amendment may be done simultaneously with the request for annexation. For property that is not zoned by the City of Auburn prior to annexation the property shall assume the R-1 designation upon annexation. For those properties lying within the Lea Hill Area and not zoned by the City prior to annexation the property shall assume the LHR1 designation upon annexation. If applicable, the planning director may be empowered to initiate a J rezone application from the R-1 or LHR1 designation to a zone compatible with the comprehensive plan. This fezone process shall occur within six months of.the date of annexation. 18.04.522 Lea Hill Area "Lea Hill Area" means that area that lies east of the Green River and is within the City's Potential Annexation Area (PAA) as illustrated in the City's Comprehensive Plan and may either be unincorporated King County or.within the corporate boundaries of the City of Auburn. A. The city is divided into the following classes of districts: 1. R~R, rural residential district (four acres per lot); 2. RoS, one-family residential district (35,000 square feet per lot}; 3. R-l, one-family residential district (8,000 square feet per lot); 4. R-2, one-family residential district. (6,000 square feet per lot); 5. R-3, one- and two-family residential district; 6. R-4, multiple-family residential district; 7. R-MHP, manufactured home park district; 8. R-O, residential office district and RO-H, residential office-hospital district; 9.
