HomeMy WebLinkAbout5376ORDINANCE NO. 5 3 7 6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING ORDINANCE NO. 5297 BY AUTHORIZING THE MAYOR TO SIGN A LOCAL AGENCY SUPPLEMENTAL AGREEMENT BETWEEN THE CITY AND THE WASHINGTON STATE DEPARTMENT OF TRANSPORTATION, APPROVING FEDERAL TEA-21 FUNDS TO PREPARE AND IMPLEMENT THE SR 18/C STREET SW RAMP MODIFICATIONS/3RD STREET SW GRADE SEPARATION PROJECT, PR 529. WHEREAS, the City Council of the City of Auburn must adopt and approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW; and WHEREAS, Ordinance No. 5297, passed October 18, 1999, approved expenditure and appropriation of $10,000,000 in Freight Mobility Strategic Investment Board funds, authorized the Mayor and City Clerk to execute a Highways and Local Programs State Funding Agreement in the amount of $10,000,000, and further authorized the Mayor and City Clerk to execute any future supplemental agreements required; and WHEREAS, Ordinances No. 5118 and 5266, passed July 22, 1998 and July 19, 1999, respectively, authorized the Mayor and City Clerk to execute a Local Agency Agreement and necessary supplements in the amount of $3,000,000 and $5,800,000 of federal TEA-21 funding; and WHEREAS, the Freight Mobility and Strategic Investment Board (FMSIB) funds in the amount of $10,000,000 are currently not available; and Ordinance No. 5 3 7 6 04/17/00 Page 1 WHEREAS, the Puget Sound Regional Council has made $10,000,000 in Federal TEA-21 funding available in lieu of the Freight Mobility Strategic Investment Board funds; and WHEREAS, the existing Local Agency Agreement must be supplemented to obligate this funding; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. PURPOSE: Auburn City Ordinance No. 5297, passed October 18, 1999, is hereby amended to reflect acceptance of $10,000,000 in Federal TEA-21 funds as the FMSIB funds are not currently available and hereby authorizes the Mayor and City Clerk to execute the Local Agency Supplemental Agreement between the City and the Washington State Department of Transportation, a copy of which is attached hereto as Exhibit "A" and is incorporated herein by reference. The Mayor and City Clerk are also authorized to approve and execute any future supplemental agreements thereto required for completion of phases of the project, including but not limited to design, right-of-way, and construction, and limited to the total amount of $18,800,000. Section 2. CONSTITUTIONALITY OR INVALIDITY: If any section, subsection, clause, phrase, or sentence, of this Ordinance, is for any reason Ordinance No. 5 3 7 6 04/17/00 Page 2 held to be invalid or unconstitutional, such invalidity or unconstitutionality of the remaining portions of this ordinance, as it is being hereby expressly declared that this ordinance and each section, subsection, clause, phrase, or sentence, hereof would have been prepared, proposed, adopted, and approved and ratified irrespective of the fact that any one or more section, subsection, clause, phrase, or sentence, be declared invalid or unconstitutional. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 4. This ordinance shall take effect and be in force five (5) days from and after its passage, approval, and publication, as provided by law.
