ORDINANCE NO. 5 3 7 8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, APPROVING THE FINAL PLAT OF DORRIE LANE SUBDIVISION, A 16 -LOT SINGLE FAMILY SUBDIVISION LOCATED AT THE SOUTHWEST CORNER OF SOUTH 310" AND 'W' STREET NW, WITHIN THE CITY OF AUBURN, WASHINGTON. WHEREAS, at the regular meeting of the Auburn City Council held on April 17, 2000, the Auburn City Council approved the Final Plat of Dorrie Lane subdivision, Application No. PLT0003-97, based on the following: FINDINGS OF FACT The Final Plat as submitted is in compliance with the Preliminary Plat approved by Resolution No. 2975 in 1998, and all applicable conditions have been met. Dorrie Lane is a 16 lot single family subdivision located South of 316'' and West of "W" Street NW within the City of Auburn. C. -I, 2. The Final Plat is in compliance with the Zoning and Land Division Ordinance and is consistent with the City's C-4 engineering standards. The applicant has posted a performance bond in the amount of $87,000 to cover the remaining construction costs of the streets and street trees. 3. The City Engineer has reviewed and approved said bond and has issued a certificate of improvements for the final plat. CONCLUSIONS OF LAW 1. The Final Plat is in compliance and in conformity with applicable Zoning and Land Division Ordinances and other applicable land use controls. Ordinance 5378 April 19, 2000 Page 1 2. The Plat is consistent with the Comprehensive Plan. 3. The Plat meets the requirements of Chapter 58.17 RCW. Based on the foregoing Findings of Fact and Conclusions, the final plat is hereby approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Purpose. The Plat of Dorrie Lane, is a 16 lot single-family subdivision located South of 316th Street and West of "W" Street NW, within the City of Auburn, Washington, which Plat is on file with the City Clerk of the City of Auburn, and which plat is legally described on the face of the Final Plat and LJO setforth in Exhibit "A", is attached hereto and incorporated herein by this reference. `Y' Section 2. Pursuant to RCW 58.17.170, the final plat conforms to all terms C1.4. C=3 of the preliminary plat approval and complies with all requirements of Chapter 58.17 RCW and. applicable state and local laws. Section 3. Constitutionality or Invalidity. If any section, subsection clause or phase of this Ordinance is for any reason held to be invalid or unconstitutional such invalidity unconstitutionality shall not affect the validity or Ordinance 5378 April 19, 2000 Page 2 constitutionality of the remaining portions of this Ordinance, as it is being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed adopted and approved and ratified irrespective of the fact that nay one or more section, subsection, sentence, clause or phase be declared invalid or unconstitutional. Section 4. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor. Section 5. Implementation. The Mayor is hereby 'authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Ln Ln Section 6.
