HomeMy WebLinkAbout5395 ORDINANCE NO. 5 3 9 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, REPEALING AUBURN CITY CODE SECTION 10.36,330 ENTITLED "NO PARKING BETWEEN 4:00 A.M. AND 6:00 A.M.", AS CONTAINED IN AUBURN CITY CODE TITLE 10, ENTITLED "VEHICLES AND TRAFFIC" CHAPTER 10.36 ENTITLED "STOPPING, STANDING AND PARKING", FOR THE PURPOSE OF CORRECTING INACCURACIES IN THE CODE SECTION AS PRESENTLY WRI'I'FEN. WHEREAS, Pursuant to RCW 35A.11.020 entitled "Powers vested in legislative bodies of noncharter and charter code cities" the Council of the City of Auburn has been provided the power to regulate its local municipal affairs appropriate to the good government of the city; and WHEREAS, the City desires to correct and update the existing Auburn City Code section 10.36.330 entitled "No Parking Between 4:00 a.m. and 6:00 a.m., Except Sundays and Holidays"; and WHEREAS, it has been determined that repealing the present Auburn City Code Section entitled "No Parking Between 4:00 a.m. and 6:00 a.m., Except Sundays and Holidays" is the appropriate method for facilitating identified needed changes to the Auburn City Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Ordinance No. 5395 Date June 5, 2000 Page 1 Section 1. PURPOSE. The purpose of this Ordinance is as follows: To repeal Auburn City Code Section 10.36.330 entitled "No Parking Between 4:00 a.m. and 6:00 a.m., except Sundays and Holidays", attached hereto as Exhibit "A", to facilitate the correcting of inaccuracies as presently exist in this code section. Section 2. Constitutionality or Invalidity. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed, adopted and approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 4. This Ordinance shall take effect and be in force from and after five (5) days from date of publication.
