HomeMy WebLinkAbout5396 ORDINANCE NO. 5 3 9 6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, ADOPTING AUBURN CITY CODE SECTION 10.36.330 ENTITLED "NO PARKING BETWEEN 4:00 A.M. AND 6:00 A.M. ON MONDAYS AND WEDNESDAYS", AS CONTAINED IN AUBURN CITY CODE TITLE 10, ENTITLED "VEHICLES AND TRAFFIC" CHAPTER 10.36 ENTITLED "STOPPING, STANDING AND PARKING". WHEREAS, Pursuant to RCW 35A.11.020 entitled "Powers vested in legislative bodies of noncharter and charter code cities" the Council of the City of Auburn has been provided th~ power to regulate its local municipal affairs appropriate to the good government of the city; and WHEREAS, the City desires to correct former Auburn City Code section 10.36.330 entitled "No Parking Between 4:00 a.m. and 6:00 a.m., Except Sundays and Holidays" as repealed by Ordinance No. 5395 to reflect the present needs of the residents in the area; and WHEREAS, it has been determined that adopting a new Auburn City Code Section 10.36.330 entitled "No Parking Between 4:00 a.m. and 6:00 a.m. on Mondays and Wednesdays" is the appropriate method for facilitating identified changes to the former Auburn City Code 10.36.330. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Ordinance No. 5396 Date June 5, 2000 Page 1 Section 1. PURPOSE. The purpose of this Ordinance is as follows: To adopt Auburn City Code Section 10.36.330 entitled "No Parking Between 4:00 a.m. and 6:00 a.m. on Mondays and Wednesdays" to allow area residents to park near their residences with the exception of between the hours of 4:00 a.m. and 6:00 a.m. on Mondays and Wednesdays as attached hereto as Exhibit "A" and adopted herein by this reference. Section 2. Constitutionality or Invalidity. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed, adopted and approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. It is unlawful to park any vehicle on Main Street between the Burlington Northern Santa Fe Railroad Company right-of-way and "E" Street Southeast, in the city, between the hours of 4:00 a.m. and 6:00 a.m. on Mondays and Wednesdays.
