HomeMy WebLinkAbout5411 ORDINANCE NO. 5 4 1 I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING ORDINANCE 5351 TO INCREASE THE FUNDING IN CONTRACT EM010177 FROM AN AMOUNT NOT TO EXCEED SEVEN THOUSAND THREE HUNDRED SIXTY-NINE DOLLARS ($7,369.00) TO FIFTEEN THOUSAND SEVENTY-FIVE DOLLARS ($15,075.00) AS REIMBURSEMENT FROM THE STATE OF WASHINGTON MILITARY DEPARTMENT, EMERGENCY MANAGEMENT DIVISION, WHICH FUNDING COMES FROM THE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA) AND AUTHORIZING ACCEPTANCE, OF THE INCREASED APPROPRIATION AND EXPENDITURE OF SAID FUNDS FOR THE SOLE PURPOSE OF SUPPORTING STATE AND LOCAL ASSISTANCE (SLA) PROGRAMS AS PROVIDED BY FEMA. WHEREAS, the Auburn City Council of the City of Auburn must adopt and approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW; and WHEREAS, acceptance of the increased funding from the State of Washington Military Department, Emergency Management Division Contract EM010177A, which funds have been increased as provided by the Federal Emergency Management Agency (FEMA) for the sole purpose of supporting State and Local Assistance (SLA) programs that will benefit the citizens of Auburn; and O~inance No. 5411 June 15,2000 Page 1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Purpose. Pursuant to Chapter 35A.33 RCW the City Council hereby authorizes the execution of an amendment to Contract No. EM010177 between the Washington Military Department and the City of Auburn to increase the amount of funding from Seven Thousand Three Hundred Sixty- nine ($7,369.00) to an amount not to exceed Fifteen Thousand Seventy-five ($15,075.00) Dollars and approves the increased appropriation and authorizes expenditure of such funds which are reimbursement from the State of Washington Military Department, Emergency Management Division, as provided by the Federal Emergency Management Agency (FEMA) for the sole purpose of supporting State and Local Assistance (SLA) programs as provided by FEMA. A copy of said amendment contained in Contract EM010177A is attached hereto as Exhibit "A" and is incorporated herein by this reference. Each and every provision of the original contract except as amended herein shall remain in full force and effect. Section 2. The City shall use the funds for the purpose of supporting State and Local Assistance (SLA) programs as provided by FEMA from October 1, 1999 to September 30, 2000. Ordinance No. 5411 June 15, 2000 Page 2 Section 3. Constitutionality and Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 4. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. Effective Date. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. FUNDING The funding of this contract is increased by $7,706 from $7,369 to $15,075. Paragraph 2. SERVICE PROVISIONS No change in scope of work results from this amendment Paragraph 3. CONTRACT PERIOD No change in contract period results from this amendment Paragraph 4. REIMBURSEMENT PROVISIONS No change in contract period results from this amendment This amendment shall be read in conjunction with the original contract. Each and every provision of the original contract except as amended herein shall remain in full force and effect. Any reference to contract shall mean contract as amended.
