AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
AN INTERLOCAL AGREEMENT ESTABLISHING A TEAM SUPERVISOR FOR
THE AUBURN AMERICORPS TEAM AND SETTING FORTH THE
RESPONSIBILITIES OF EACH PARTY.
WHEREAS, the City of Auburn, through its Neighborhood Program,
participates in the National Service Corporation's AmeriCorps Program.
WHEREAS, through a grant provided by the Washington State
Employment Security Department's Washington Service Corps, each year the
City of Auburn is responsible for recruiting several AmeriCorps members to serve
the Auburn community.
WHEREAS, the mission and objectives of the City of Auburn's
Neighborhood Program and its AmeriCorps Team are mutually advantageous to
the Auburn School District and the City of Auburn.
WHEREAS, nearly all of Auburn's AmeriCorps Team members currently
serve at one or more of Auburn's schools under the direction of several on-site
supervisors provided by the Auburn School District.
WHEREAS, it would be mutually advantageous to the parties to place the
AmeriCorps Team members under the supervision of a single supervisor

provided by the City of Auburn under the direct supervision of the Auburn School
District.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DOES HEREBY ORDAIN THE FOLLOWING:
Section 1. Purpose: That the City Council of the City of Auburn
approves the Interlocal Agreement Between the City of Auburn and the Auburn
School District jointly establishing a Team Supervisor for the Auburn AmeriCorps
Team a copy of which is attached as Exhibit "A" and incorporated herein by this
reference.
Section 2. Authorization: That the Mayor of the City of Auburn and the
City Clerk are hereby authorized to execute the Interlocal Agreement Between
the City of Auburn and the Auburn School District jointly establishing a Joint
Team Supervisor for the Auburn AmeriCorps Team.
Section 3. Severability. The provisions of this ordinance are declared
to be separate and severable. The invalidity of any clause, sentence, paragraph,
subdivision, section or portion of this ordinance or the invalidity of the application
thereof to any person or circumstance shall not affect the validity of the
remainder of this ordinance, or the validity of its application to other persons or
circumstances.

Section 4. Implementation: The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out the
directives of this legislation.
Section 5. Effective Date: This ordinance shall take effect and be in
force five days from and after its passage, approval and publication as provided
by law.

Interlocal Agreement between the City of Auburn and Auburn School
District Establishing a Team Supervisor for the Auburn AmeriCorps Team.
WHEREAS, this Agreement entered into between the City of Auburn, a
municipal corporation of the State of Washington (hereinafter called the "City"),
and the Auburn School District, a political subdivision of the State of
Washington (hereinafter called the "School District") provides for the joint
establishment of a Team Supervisor for the Auburn AmeriCorps Team and sets
forth the responsibilities of each party;
NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL
PROMISES AND COVENANTS CONTAINED HEREIN, THE PARTIES
HERETO AGREE AS FOLLOWS:

Cn SECTION 1 - PURPOSE: The purpose of this Agreement is to set forth the

SECTION 2 - DEFINITIONS:
2.1 Auburn AmeriCorps Team: Group of individuals who commit to eleven
months of community service under the direction of the City of Auburn's
Neighborhood Program and, while they perform their service
commitment, receive a stipend and other benefits from the Washington
Service Corps. Each individual member must meet the minimum
eligibility requirements established by the Washington Service Corps and
the National Service Corporation.

2.2 Auburn Neighborhood Program: A program under the direction of the
City of Auburn's Department of Planning and Community Development
that includes, among other activities, the Auburn AmeriCorps Team.
2.3 Cost Center: The sum total of all direct and indirect costs required to
support AmeriCorps Team members to a specific site.
2.4 Allocation: That portion of the City of Auburn's Neighborhood Program
budget that is directly attributable to fund the AmeriCorps services at a
particular cost center.
2.5 Program Year: The start and end dates of the AmeriCorps Team
member's eleven month service commitment is typically the period from
September 16 to August 15.
�n 2.6 Program Coordinator: City of Auburn employee assigned to manage and
rn administer the City of Auburn's Neighborhood Program and the

N 2.7 Washington Service Corps: An agency of the State of Washington's

Department of Employment Security that is the grantor of the funds

necessary to implement the Auburn AmeriCorps program.

SECTION 3 -MISSION STATEMENT: The Auburn Neighborhood Program and
its AmeriCorps Team strive to create and maintain safe, connected
neighborhoods that have at their core a strong attachment to schools and an
equally strong desire for children to succeed in school to the best of their
abilities.

SECTION 4 -OBJECTIVES OF THE AUBURN AMERICORPS TEAM: The
objectives of the Auburn AmeriCorps Team are established through an
agreement with the Washington Service Corps who provides funding for the
operation of the AmeriCorps Team. The Auburn AmeriCorps Team strives to
accomplish the following at their assigned sites:
4.1 Reduce the number of assaults and incidences of property theft in and
around schools by organizing a School Crime Watch group and holding
at least five workshops per year to train adults and teens in crime
prevention, conflict resolution, cultural diversity and mediation. Draft and
distribute a quarterly crime prevention newsletter.
4.2 Reduce the absentee rate of students who are at -risk of suspension due
to their classroom behavior and/or truancy by helping school officials
process Becca Bill referrals, providing one-on-one tutoring and
organizing "Friendship Clubs".
4.3 Create an attachment between students and their neighborhoods as
demonstrated by an increase in the number of volunteer hours students
provide performing community service.
SECTION 5 -PLACEMENT OF THE AUBURN AMERICORPS TEAM: The City
agrees to locate the AmeriCorps Team at schools under the auspices of the
School District. The Team will be split into "squads". Each squad will be placed
at a middle school selected by the School District.
SECTION 6 -RESPONSIBILITIES OF THE TEAM SUPERVISOR: The City will
provide funding for the Team Supervisor position which will be under the direct
supervision of the Auburn School District. The School District's operational

policies and procedures will apply to this position. Both the City and the School
District will jointly participate in the selection of the Team Supervisor. The
Team Supervisor will perform the following duties and assume the following
responsibilities:
6.1 General Assignment: Direct and/or coach the Auburn AmeriCorps
members to form a team that works well together, facilitates team
meetings, takes initiative to organize and implement activities to
complete the Team objectives, and fosters the development of a culture
dedicated to community service and good citizenship among the team
members.
6.2 Recruitment: Help the Program Coordinator recruit a diverse team of
AmeriCorps Team members willing to make an eleven month service
Ln commitment and capable of accomplishing the objectives of their service
.a assignment. The Team Supervisor will lead the recruitment of teens and

young adults for the AmeriCorps program. Work will include, but is not
limited to, making public presentations, attending job and career fairs,
C distributing posters and flyers, and encouraging potential members to
apply.

6.3 Training: Implement a training program that results in 80% of the
members receiving training in conflict resolution, communication skills,
career development, service-learning/reflection, diversity awareness,
leadership skills, and team building.
6.4 Member Development: Supervise, mentor and coach individual
members toward the successful completion of their service assignment

and term of service. Monitor the AmeriCorps member's time and assure
it is reported accurately on their bi-weekly time sheets. Evaluate the
member's performance once during the months of January -February,
2001 and once during the months of April -May, 2001. Coach and mentor
members who are falling behind in their hours and/or experiencing
difficulty with their service assignment. Make arrangements for the
members to receive the training and/or extra assignments they need to
catch up. Coordinate and direct the Team to have at least two meetings
per month. Train the Team members on how to facilitate the meetings
and organize service projects.
6.5. Community Service: Participate in training and provide hands-on
experiences that will result in 80% of all members completing their term
of service with a strengthened or reinforced service ethic. Help the
Team organize a celebration of Martin Luther King Day and at least one
service project during the month of April. Direct the AmeriCorps Team to
recruit 50 non-AmeriCorps member volunteers to participate in local and

national service projects in education, environment, human service or
public safety issue areas that will bond volunteers to the community and

N result in 500 hours of service.

o SECTION 7 -RESPONSIBILITIES OF THE AUBURN SCHOOL

`V DISTRICT: The School District will supervise, coach and train the Team
Supervisor. The Assistant Superintendent, or his/her designee, will
solicit comments from the City, from involved school staff and from
individual Auburn AmeriCorps members for the purpose of conducting
quarterly evaluations of the Team Supervisor. A copy of each of the

quarterly performance appraisals will be promptly provided to the
Program Coordinator. In addition to the direct supervision of the Team
Supervisor, the School District will make available to the Team
Supervisor and the AmeriCorps Team members training, and/or
opportunities to receive training which is appropriate and relative to their
individual assignments. It will provide the Team Supervisor and the
AmeriCorps members a workstation including tools and office equipment
necessary to complete their assignments. The School District will
cooperate and assist the City in monitoring and evaluating the
effectiveness of the program.
SECTION 8 -RESPONSIBILITIES OF THE CITY OF AUBURN: The City will
designate a planner to serve as the Program Coordinator. Working in
conjunction with the School District and the Team Supervisor, the Program
Coordinator will provide the following services:

program in accordance with the requirements of applicable grant
cl' agreements and City and/or School District policies and guidelines. The

Program Coordinator will prepare the grant applications to sustain the

mission of the Neighborhood Program and the Auburn AmeriCorps
o Team.

8.2 With the help of the Team Supervisor, recruit a diverse team of
AmeriCorps members willing to make an eleven month service
commitment and capable of accomplishing the objectives of their service
assignment. The Program Coordinator will lead the Program's
recruitment of college students and adults. Work will include making

arrangements for newspaper advertisements, public presentations,
attending job and career fairs, distributing posters and flyers, and
encouraging potential members to apply.
8.3 Organize and make arrangements for a two-week orientation of the
AmeriCorps members. Orientation will include enrolling the members
into the AmeriCorps program and providing them an overview of the
program's mission and objectives. Training during orientation will include
first aid and CPR, crime prevention, diversity awareness, School District
procedures and policies, group facilitation and team building.
8.4 Make arrangements for the individual members to obtain the training
specified in their development plan. The Program Coordinator will
review each of the performance appraisals for each team member and
will take whatever remedial and/or corrective action is needed for
individual AmeriCorps Team members. The Program Coordinator will
monitor the service hours earned by each member and will issue any low
hour warnings that may be necessary and will arbitrate and/or mediate

disputes and/or grievances between the Team members.
8.5 Develop and implement an evaluation plan to monitor the performance

C> and effectiveness of the AmeriCorps Team. The Program Coordinator
o will collect the necessary data and prepare the analysis stipulated in the

`" evaluation plan. The Program Coordinator will prepare the progress
reports and other reports requested by the Auburn School District, the
Washington Service Corps and its agencies.

8.6 Make an annual presentation to the City Council, School Board and/or
their subcommittees on the progress of the AmeriCorps Teams and
plans for the next program year. The Program Coordinator will handle
public complaints, inquires and request for information.
SECTION 9 -PROGRAM MONITORING AND EVALUATION: The AmeriCorps
grant requires the periodic evaluation of program effectiveness. The City's
Program Coordinator will collect the necessary data and prepare the reports
required by the Washington Service Corps. The School District will need to
make the following information available: attendance records, grades and test
scores of students assigned as AmeriCorps mentorttutors, attendance of
volunteers at AmeriCorps projects and workshops.
SECTION 10 - COSTS OF SERVICES AND PAYMENT PROCEDURES:
10.1 The City will serve as the fiscal agent for the program. The Program
Coordinator will manage the program budget and administer the
disbursement and collection of the program funds. The Program
Coordinator will prepare the necessary financial statements, vouchers

and invoices required by the Washington Service Corps, the City and the
N School District.
10.2 Each school site with a team of AmeriCorps members is designated as a
"cost center" in the City of Auburn's Neighborhood Program annual
budget. The City will allocate funds for each cost center. The Auburn
AmeriCorps Team is recognized as one cost center and each school site
is recognized as a separate cost center. These funds provide
operational support for training, contracted services, supplies, materials,

transportation and equipment. Funds allocated to a cost center must be
used solelv and strictly to support the placement of the assigned
AmeriCorps members and the activities or services that they directly
generate or provide.
10.3 To access the Team's operational budget, the School District must
submit to the City a request for a purchase order. This request must be
prepared on the forms provided by the City. The purchase order
requisition form must be signed by the Team Supervisor and approved
by the Program Coordinator. The City will directly pay the vendor
following the receipt of an invoice and/or other supporting
documentation.
10.4 The School District will help the City satisfy its in-kind match required by
WA the AmeriCorps grant. This in-kind match may consist of the staff time
';z supervising the AmeriCorps members or any other costs incurred by the

Q; School for activities involving the AmeriCorps members for which it does

w not request reimbursement. The School District will submit these in-kind
e ' contributions on vouchers provided by the City.

SECTION 11 - DURATION AND TERMINATION

11.1 DURATION: This Interlocal Agreement shall be effective upon execution
by the City and the School District and shall remain in force and effect
from September 1. 2000, through August 30, 2001.
11.2 RENEWAL: This Agreement shall be renewed automatically for one
year periods commencing on September 1 and ending August 30 unless

either party notifies the other in writing of its intent to terminate the
Agreement as provided in this Agreement.
11.3 TERMINATION: This AGREEMENT may be unilaterally terminated
without cause upon the written notice of either the Mayor or the
Superintendent. The effective date of the termination will be thirty days
from date of the written notice.
11.4 MODIFICATION: This Agreement may be modified by further written
agreement upon mutual acceptance by both parties.
SECTION 12: INSURANCE AND HOLD HARMLESS: Both parties agree to
provide each other evidence of insurance coverage for the entire period in
which the Team Supervisor performs services under this Agreement. Said
certificates of insurance will provide general liability coverage of at least
$1,000,000.00.

12.1 The School District agrees to defend, indemnify and hold harmless the

City and its appointed and elected officers, employees and agents from
and against any and all liability, loss, costs, damage and expense,

including costs and attorney fees in defense thereof, because of actions,
c claims or lawsuits for damages resulting from action or inaction of the

Team Supervisor during such time that the Team Supervisor performs
services under the direction of the Auburn School District.
12.2 The City agrees to defend, indemnify and hold harmless the School
District and its appointed and elected officers, employees and agents
from and against any and all liability, loss, costs, damage and expense,
including costs and attorney fees in defense thereof, because of actions,

claims or lawsuits for damages resulting from action or inaction of the
Team Supervisor during such time that the Team Supervisor performs
services under the direction of the City of Auburn.
SECTION 13: APPLICABLE LAW AND VENUE: This Agreement shall be
construed and interpreted in accordance with the laws of the State of
Washington. In the event of a dispute, such dispute shall be litigated in the
Superior Court of King County, Washington.
SECTION 14: NON-DISCRIMINATION: Parties shall not discriminate in any
manner on the basis of race, color, national origin, sex, religion, age, marital
status or disability in employment or the provision of services.
SECTION 15: SEVERABILITY: The provisions of this agreement are declared
to be separate and severable. The invalidity of any clause, sentence,
paragraph, subdivision, section or portion of this agreement or the invalidity of
.n the application thereof to any person or circumstance shall not affect the validity

SECTION 16: ENTIRE AGREEMENT: This Agreement constitutes the entire
agreement between the parties. Any modifications or amendments to this
Agreement shall be in writing and shall be signed by each party.
