Assessor's PropertyTax Parcel/Account Number: 0520062 026 0520062 024 0520062 701 D Assessor ~x # not yet ass~ned ORDINANCE NO. 5 3 7 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, ADDING A NEW CHAPTER 18.78 ENTITLED "TERRACE VIEW (TV) ZONING DISTRICT" WHICH SETS FORTH THE ZONING REQUIREMENTS AND STANDARDS APPLICABLE TO THE TERRACE VIEW DISTRICT WHICH CHAPTER IS CONTAINED IN TITLE 18 ENTITLED "ZONING"; AND SECTIONS 18.48.010 ENTITLED "PURPOSE" AND SECTION 18.48.020 ENTITLED "PERMITTED USES" AND SECTION 18.48.030 ENTITLED "DEVELOPMENT STANDARDS" AND SECTION 18.48.040 ENTITLED "SITE PLAN". WHEREAS, Terrace View property is a 52.86 acre parcel of property that is in Pierce County. The property lies east of the East Valley Highway and abuts the Auburn City Limits at the King/Pierce County line. The property also abuts the Lakeland project in Pierce County and is within the City's Potential Annexation Area (PAA); and WHEREAS, the Terrace View property is a reclaimed mining site that the owner has been working with Pierce County for a number of years to develop. An Environmental Impact Statement has been prepared and the County has zoned the property to allow for a mixed used development of commercial and multi- family. The developer of the project is proposing to construct 625 units of multi- family and about 71,600 square feet of commercial; and WHEREAS, Terrace View requires public sewer and water and the City of Auburn will provide those utilities. A separate annexation agreement has been approved by the City Council. The agreement among other requirements will require annexation to the City as determined by the City; and Ordinance 5377 April 24, 2000 Page ]. WHEREAS, the City in 1998 also approved a change to the Comprehensive Plan map that illustrated the area to be appropriate for heavy commercial uses. This was done I anticipation of it being annexed and to reflect he County approvals; and WHEREAS, the project as approved by Pierce County does not fit nicely into one of the City's existing zoning categories. For example the height of some of the buildings will exceed the height limitations of the R-4 zone; and WHEREAS, ,it is proposed to create a new zoning district exclusively for the Terrace View project. This would be consistent with the Pierce County approvals and what the City had anticipated with the change in the Comprehensive Plan. The zoning district will be a modified version of the C-3 zone. The modifications are that the multi-family project will be permitted outright. The C-3 zone does allow for multi-family except that a conditional use permit is required. The other modification is to not require parking for recreational vehicles. The City requires parking areas for recreational vehicles in large multi-family projects. The Terrace View project does not anticipate recreational vehicles and will have a convenant that restricts them from the project. Otherwise, all other requirements of the City's Zoning code will apply to the project; and WHEREAS, upon annexation, the property would assume the Terrace View (TV) zoning district, Ordinance 5377 April 24, 2000 Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS Section '1. Pumose. To enact a new Chapter 18.78 entitled "Terrace View (TV) Zoning District" contained in Title 18 entitled "Zoning" and certain zoning code text amendments reflecting the addition of the newly created Terrace View District regarding the Terrace View Annexation Area identified on the attached Exhibit "A". Section 2. This ordinance together with Exhibit "A" which is attached hereto and incorporated herein by this reference does hereby enact a new Auburn City Code Chapter 18.78 entitled "Terrace View (TV) Zoning District" which chapter is contained in Title ~ 8 entitled "Zoning" and does hereby enact Section ~8.78.0'10 entitled "Purpose", Section ~ 8.78.020 entitled "Permitted Uses", Section '18.78.030 entitled "Development Standards", and ~ 8.78.040 entitled "Site Plan" to reflect the addition of the newly created Terrace View (TV) Zoning District. Section 3. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor, Division of Records and Elections. Section5. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 6. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law. Reynolds City Attorney Ordinance 5377 April 24, 2000 Page 5 E~libit A, Ord/nance 5377 Chapter 18.78 TERRACE VIEW (TVJ ZONING DISTRICT SECTIONS: 18.78,010 Purpose 18.78.020 Permitted uses 18.78.030 Development Standards 18.78.040 Site Plan 18.78.010 Purpose The purpose of the Terrace View zoning district is to establish zoning requirements for the property commonly known as "Terrace View" which is located on the south side of the King/Pierce County line and east of the East Valley Highway. The parcel is approximately 52.66 acres in size. The Terrace View zoning district will reflect, in part, zoning provisions allowed by Pierce County and project submittals to Pierce County. Because of this the Terrace View zoning district will be a modified version of the Cily of Auburn C-3, Heavy Commercial, zoning district. The Terrace View zoning district also reflects the City of Auburn Comprehensive Plan map which was amended in 1998 to illustrale the properly as heavy commercial. 18.78,020 Permitted uses The permitted uses allowed in the Terrace View zoning district will be those as allowed within Chapter 18.30, C-3 Heavy Commercial District, as may be amended. The process to allow any use on the Terrace View property shall be as required by Title 18 with the exception that apartments/multi- family units will be considered an outright permitted use and will not require a conditional use permit. 18.78,030 Development Standards All development standards of Title 18 will apply to the Ten'ace View property with the exception that no recreational vehicle parking spaces will be required if there are perpetual restrictive covenants recorded against the property that do not allow recreational vehicles to be parked in the multi-family complex. The restrictive covenants shall be approved by the City of Auburn and shall be recorded by the applicant prior to any building permits issued by Pierce County or the City of Auburn for any multi-family structure. An original recorded copy shall be provided to the City of Auburn. Any subsequent amendments to the approved covenants must be approved by the City of Auburn and recorded. Any recreational vehicles on the property that are in violation of this covenant shall be considered a violation of the Auburn Zoning Ordinance and will be subject to the provisions of Auburn City Code, Chapter 1.25, Civil Penalties for Violations. The owner/manager of the Terrace View propedy will be the party responsible for complying with Chapter 1.25. 18.78.040 Site Plan A. The location of the commercial and multi-family areas shall generally be consistent with the site plan entitled '"Terrace View - Apartments'" and labeled as exhibit "A". The commercial area shall not exceed 10 acres. B. Minor Site Plan Amendment Minor amendments to the approved site plan may be made after review and approval by the Planning Director. Minor amendments are those which may affect the precise dimensions, design or arrangement of the buildings or other on site improvements. A minor amendment will not change the basic character or design of the original approval or increase the impacts of the proposed development. C. Major Site Plan Amendment Major amendments are those that the Planning Director determines are significant changes to the design, character, intensity, density, use, etc. of the original site plan.
