HomeMy WebLinkAbout5459 ORDINANCE NO. 5 4 5 9 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, TO AMEND ORDINANCE NUMBER 5065, AS AMENDED BY ORDINANCE NUMBER 5311, WHICH APPROPRIATED COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS IN 1998, AND ORDINANCE NUMBER 5190, WHICH APPROPRIATED CDBG FUNDS IN 1999, AND ORDINANCE NUMBER 5311, WHICH APPROPRIATED CDBG FUNDS IN 2000, TO RELEASE CERTAIN UNUSED CDBG FUNDS IN ORDER TO REAPPROPRIATE SUCH FUNDS FOR USE DURING THE 2001 CDBG PROGRAM YEAR IN ADDITION TO THE CITY'S ENTITLEMENT FUNDS; AND TO APPROPRIATE A TOTAL AMOUNT OF FOUR HUNDRED FIFTY-FOUR THOUSAND FOUR HUNDRED AND NINETY-TWO DOLLARS ($454,492) FOR THE 2001 PROGRAM YEAR; AND TO AUTHORIZE THE MAYOR TO IMPLEMENT THE APPROVED PROGRAMS AND PROJECTS. WHEREAS, the City Council of the City of Auburn must adopt and approve all appropriations by ordinance pursuant to Chapter 35A RCW; and WHEREAS, the City is an entitlement applicant for Community Development Block Grant (CDBG) funds under the Housing and Community Development Act of 1974 (the Act), Pub. L. 93-383 as amended, and will receive CDBG funds for the purpose of carrying out eligible community development and housing activities under the Act and under regulations promulgated by the Department of Housing and Urban Development (HUD) at 24 CFR Part 570; and WHEREAS, according to RCW 35A.33.150 special fund appropriations do not lapse but carry forward from year to year until fully expended or the Ordinance 5459 October 13, 2000 Page 1 purpose has been accomplished or abandoned without necessity of reappropriation; and WHEREAS, it is in the best interest of the City of Auburn and its citizens to amend Ordinances Numbered 5065, 5190, and 5311 to release certain unused specified funds appropriated therein and to reappropriate those funds for the 2001 Program Year in order to address current needs; and WHEREAS, the City desires to award certain funds for use as described within this Ordinance, for the purpose of implementing eligible activities under the Act and HUD regulations; and WHEREAS, the Legislature has declared that carrying out the purposes of federal grants or programs is both a public purpose and an appropriate function for a city, town, county, or public corporation; NOW THEREFORE THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO HEREBY ORDAIN THE FOLLOWING: SECTION'I. Purpose. Amendment to Ordinance No. 5065 as amended by Ordinance No. 5311 to reallocate a total of Ten Thousand Dollars ($10,000) to the 2001 Program Year. Ordinance No. 5065, approved by the Auburn City Council on February 11, 1998 and amended by Ordinance No. 5311 on October 26, 1999, is hereby amended to release funds in the amount of Ten Thousand Dollars ($10,000) which were allocated to EiderHealth Nodhwest for facility improvements, as provided for in "Exhibit A," which was incorporated by reference into Ordinance 5459 October 13, 2000 Page 2 Ordinance No. 5065. The funding was not used, creating the necessity for reappropriation and reallocation of the entire $10,000 for use in the 2001 CDBG Program Year. SECTION 2. Amendment to Ordinance No. 5190 as amended by Ordinance No. 5311 to reallocate a total of Thirty-Two Thousand Four Hundred Ninety-Two Dollars ($32,492) to the 2001 Program Year. Ordinance No. 5190 approved by the Auburn City Council on December 1, 1998, is hereby amended to release funds in the amounts of Thirty-Two Thousand Four Hundred Ninety-Two Dollars ($32,492) which was allocated to the Department of Planning and Community Development for CDBG Administration as provided in Exhibit "A," which was incorporated by reference in Ordinance No. 5190. "Exhibit A" of Ordinance No. 5190 provides: Pro.c~ram Administration $ 75,000 Salary, benefits and program materials necessary to implement, monitor and administer eligible CDBG activities. {CDBG eligible under 24CFR 570.206} The funding was not completely used, creating the necessity for reappropriation and reallocation of the balance of funds for use in the 2001 CDBG Program Year. SECTION 3. Amendment to Ordinance No. 5311 to reallocate a total of Twenty Thousand Dollars ($20,000) to the 2001 Program Year and to modify the contracts numbered BG0004, BG0007, and BG0005 as referenced in Ordinance No. 5311. Ordinance No. 5311, approved by the Auburn City Council on October 26, 1999, is hereby amended to release funds in the amount of Twenty Thousand Dollars ($20,000) allocated to Ordinance 5459 October 13, 2000 Page 3 Community Psychiatric Clinic for facility construction, as provided for in "Exhibit A," which was incorporated by reference into Ordinance 5311. "Exhibit A" of Ordinance No. 5311 provides: Community Psychiatric Clinic $ 20,000 Acquisition of property in unincorporated South King County to be used for the construction of a temporary shelter for Chronic Public Inebriates from throughout South King County. {CDBG eligible under 24CFR 570.201 (a)} The funding was not used, creating the necessity for reappropriation, and reallocation of the entire $20,000 for use in the 2001 CDBG Program Year. In addition, "Exhibit A" of Ordinance No. 5311 provides: Citv of Auburn's Housing Repair Program $169,493 Grants of less than $3,000 and/or loans of less than $10,000 for necessary repairs and renovation of single family homes owned and occupied by low and moderate income households at various locations throughout Auburn. A maximum of $125,000 of these funds is to be used on a city-wide basis; the remainder of funds are to be used to support neighborhood planning efforts in the "A" Street/Terminal Park neighborhood. {CDBG eligible under 24CFR 570.202} Neighborhood planning was not undertaken during the Program Year, thus necessitating the release of the remaining contract amount of $44,493 for use on a city-wide basis. In addition, "Exhibit A" of Ordinance No. 5311 provides: Ememencv Shelters and Transitional Housinq $10,000 Start-up Operational support for emergency shelter for single women to be established and operated by Catholic Community Services at a location in Kent. {CDBG eligible under 24CFR570.201 (e)} Catholic Community Services $ 20,000 Women's Shelter Ordinance 5459 October 13, 2000 Page 4 Construction of a 6-bed temporary shelter in Kent for single women who have been released from the Regional Justice Center. {CDBG eligible under 24CFR570.201 (c)} The agency was unable to use the operational funds during the required time period, thus necessitating the reappropriation of those funds into the capital contract for the same project. SECTION 4. CDBG Budget for 2001 Program Year. The City Council of the City of Auburn hereby approves the reappropriation of the amounts provided in Sections I through 3 hereof and combines these aforementioned amounts, totaling Sixty-Two Thousand Four Hundred Ninety-Two Dollars ($62,492) into the City of Auburn's 2001 CDBG entitlement of Three Hundred Ninety-Two Thousand Dollars ($392,000), for a combined 2001 CDBG program budget of Four Hundred Fifty-Four Thousand Four Hundred Ninety-Two Dollars ($454,492) for programs, projects, and administrative costs recommended by the Human Service Committee and approved by the Planning and Community Development Committee for the 2001 CDBG Program Year. Specific expenditures for the 2001 Program Year are itemized in Exhibit "A," attached hereto and incorporated herein by this reference. Disbursement of CDBG funds for a specific program or project shall not exceed the amount appropriated, as indicated on the itemized budget set forth in Exhibit "A," to this Ordinance No. 5459 for that particular program or project. Ordinance 5459 Ostober 13, 2000 Page 5 SECTION 5. Prereauisites for Use of CDBG Funds. Grant recipients must certify that their planned use of CDBG funds complies with the following: (a) Compliance with national objectives. Grant recipients must certify that their use of CDBG funds gives maximum feasible priority to activities that benefit low and moderate income residents or aid in the prevention or elimination of sums or blight. (b) Compliance with environmental review procedures. Grant recipients must certify their compliance with environmental review procedures set forth in 24 CFR, part 58, for each activity as applicable. SECTION 6. Limitations on Expenditures and Adjustments. No appropriation shall be made in excess of actual revenues and no liability is to be incurred in excess of appropriations. In the event that actual revenues are different than the revenues estimated by the CDBG budget, the following actions shall be taken: (a) Public Service Programs: In the event the City receives a different amount of funding than its budgeted CDBG entitlement, each appropriation for public services will receive a proportionately equal reduction (increase) in its appropriation relative to the total decrease (increase) in total revenues. (b) Cal~ital-Funds Pro.clrams: Appropriations for capital projects, including the Housing Repair Program, shall be released only when actual revenues Ordinance 5459 October 13, 2000 Page 6 are sufficient to fully fund the appropriation unless both the recipient Agency and the City mutually agree to a partial funding of the Agency's original appropriation. Partial funding of an appropriation will release the City from further obligations to fund that particular appropriation and, thereby, allow the City to consider funding either all or part of another appropriation. In the event that the City receives more than its budgeted CDBG entitlement, the non-budgeted portion of the appropriation not available for public service activities will be provided to the Housing Repair Program. Funds budgeted to capital projects which are reduced in cost, thus returning funds to the CDBG program during the Program Year, will be reallocated to the Housing Repair Program. SECTION 7. Iml31ementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. SECTION 8. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. BOOTH MAYOR ATTEST: City Clerk AP ROVED AS TO FORM: City Attorney Ordinance 5459 October 13, 2000 Page 8 Exhibit 'A' 2001 Community Development Block Grant Budget (CDBG) SOCIAL SERVICE PROGRAMS Community Health Centers $25,194 Health care and routine/emergency dental care to low and moderate income people at the Auburn Community Health Center located at 105 "A" Street S.W., Auburn. {CDBG eligible under 24CFR570.201 (e)} Emergency Shelters and Transitional Housing Operational support for emergency shelters and transitional housing units provided by $17,000 the Seattle-King County YWCA for homeless people at approximately 15 locations throughout Auburn. {CDBG eligible under 24CFR570.201 (e)} Case management services provided to residents of St. Stephen's Housing Association $5,000 transitional housing project to be developed in Auburn (see below). {CDBG eligible under 24CFR570.201(e)} Emergency Services $10,000 Operational support for the Catholic Community Services' Emergency Assistance Program that provides case management and financial assistance to residents of Auburn for emergent needs such as rent/shelter, food, clothing, u~ilities, gas, medicines, households goods, furniture and referral to other social service agencies and community providers. {CDBG eligible under 24CFR201 (e)} NEIGHBORHOOD REVITALIZATION City of Auburn's Housing Repair Program $125,298 Grants of less than $4,000 and/or loans of less than $10,000 for necessary repairs and renovation of single family homes owned and occupied by low and moderate income households at various locations throughout Auburn. {CDBG eligible under 24CFR570.202} Multi-Services Center $20,000 Costs associated with acquisition and rehabilitation, including payment for unit improvements such as appliances and other permanent fixtures, of the Tall Cedars Apartments to preserve these units as long-term affordable housing for very low- income households. Property will be upgraded and on-site resident management will be fostered. {CDBG eligible under 24CFR570.202} HOMELESS/SPECIAL NEEDS FACILITIES St. Stephen's Housing Association $10,000 Funds to be used toward costs (including relocation) associated with the acquisition of Ordinance 5459 Exhibit A October 13, 2000 Page 1 Exhibit 'A' 9 unit townhouse community in Auburn for use as transitional housing for forme~y homeless families. Funds that are not expended for this use shall be reallocated to the Housing Repair program. {CDBG eligible under 24CFR570.201(c)} $5,000 Hearing Speech and Deafness Center Funds to be used for the support of program delivery space in a new multi-use building for special-needs clients. Contingent upon proof of CDBG eligibility; any ineligible funds or unused funds will be reallocated to Housing Repair. {CDBG eligible under 24CFR570.201(c)} ECONOMIC DEVELOPMENT Green River Community College Micro-Loan Program $27,000 Funds will support staff time to provide counseling and technical assistance to micro- business development and/or expansion. {CDBG eligible under 570.201 (o)} PUBLIC FACILITIES Auburn Senior Center Relocation $150,000 Remaining pre-construction work for relocation of Senior Center into vacated library. Following pre-construction, funds will be used toward capital costs of construction. {CDBG eligible under 24CFR570.20 l(c)} PROGRAM ADMINISTRATION Program Administration $60,000 Salary, benefits and program materials necessary to implement, monitor and administer eligible CDBG activities. {CDBG eligible under 24CFR570.206} Total CDBG Funds Allocated for the 2001 Program Year: $454,492 Ordinance 5459 Exhibit A October 13, 2000 Page 2
