Assessor's Property Tax Parcel/Account Number: 052005-1032 ❑ Assessor Tax # not yet assigned 0 ORDINANCE NO. 5 4 8 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, ANNEXING TO THE CITY A 40 ACRE PARCEL OF LAND KNOWN AS THE "P-4" PARK PROPERTY FOR MUNICIPAL PURPOSES. WHEREAS, the City of Auburn has acquired the 'P-4" park property, an approximately 40 acre parcel of property located on the south side of the City in Pierce County, and noncontiguous to the City of Auburn; and WHEREAS, the property obtained is to be used for municipal park purposes and therefore is for a municipal purpose; and WHEREAS, in accordance with RCW 35A.14.300 the City Council may by majority vote annex such property for a municipal purpose when owned by the City and WHEREAS, the subject property was acquired by the City on February 22, 2000, and WHEREAS, the City approved the resolution 3197 for annexation of "P- 4" park property on June 5, 2000. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Ordinance No. 5487 December 12, 2000 Page 1 Section 1. Purpose. That there shall be annexed to the City of Auburn, Washington, the property situated in the County of Pierce, State of Washington, legally described in Exhibit "A' and incorporated herein. Section 2. Constitutionality or Invalidity. If any section, subsection clause or phase of this Ordinance is for any reason held to be invalid or unconstitutional such invalidity unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it is being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed adopted and approved and ratified irrespective of the fact that nay one or more section, subsection, sentence, clause or phase be declared invalid or unconstitutional. Section 3. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the direction of this legislation. Section 4. Within ten (10) days after the effective date of the annexation referred to in this ordinance, the City Clerk of the City of Auburn shall send to the Office of the Clerk of the County Council one (1) certified copy of this Ordinance together with a copy of a letter from the Executive Secretary of the Ordinance No. 5487 December 12, 2000 Page 2 Pierce County Boundary Review Board, which letter contains a copy of the decision of the Boundary Review Board relating to this annexation. Section 5. Recording. The City Clerk of the City of Auburn shall record a certified copy of this Ordinance with the Pierce County Auditor's Office. Section 6. Effective Date. This Ordinance shall take effect and be in force five (5) days from and after passage, approval, and publication as provided by law.
