HomeMy WebLinkAbout5500ORDINANCE NO.5 5 0 0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING AUBURN CITY CODE SECTION 12.56.045 ENTITLED "AIRPORT TIE DOWN, HANGAR AND STORAGE RENTAL FEES" CONTAINED IN AUBURN CITY CODE CHAPTER 12.56 ENTITLED "AIRPORT" AUTHORIZING A SURCHARGE IN ADDITION TO THE TIE DOWN, HANGAR AND STORAGE RENTAL FEES AT THE AUBURN MUNICIPAL AIRPORT FOR THE PURPOSE OF PROVIDING INCREASED SECURITY. WHEREAS, the Auburn City Council of the City of Auburn must adopt and approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW; and WHEREAS, the Auburn Municipal airport has a security fence that covers some of the airport field and automatic gates which require electronic entrance keys; and WHEREAS, there has been an increase in theft and break-ins at the airport; and WHEREAS, The Airport Advisory Board and many of the tenants agree that additional security is warranted, and WHEREAS, the most cost-effective security is a private firm that will provide security patrols at the Airport several times each evening; and WHEREAS, a surcharge of $3.00 per month in addition to the tie down, hangar and storage monthly rental fees will provide sufficient revenue to provide increased security patrols at the airport. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DOES ORDAIN AS FOLLOWS: Ordinance No. 5500 January 8, 2001 Page 1 Section 1. Purpose. Pursuant to Chapter 35A.33 RCW, the City hereby amends Auburn City Code Section 12.56.045 entitled "Airport tie down, hangar and storage rental fees" contained in Auburn City Code Chapter 12.56 entitled "Airport" to authorize a surcharge in the amount of $3.00 per month in addition to the tie- down, hangar and storage rental fees provided in Auburn City Code Section 12.56.045 for purpose of providing enhanced security at the Auburn Municipal Airport as provided in Exhibit "A" attached hereto and by this reference incorporated herein as if fully set forth. One month's notice, as required, will be provided to all tenants. Section 2. Constitutionality or Invalidity, If any section, subsection clause or phase of this Ordinance is for any reason held to be invalid or unconstitutional such invalidity unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it is being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed adopted and approved and ratified irrespective of the fact that nay one or more section, subsection, sentence, clause or phase be declared invalid or unconstitutional. Section 3. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 4. Effective Date. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
