HomeMy WebLinkAbout5507ORDINANCE NO. 5 5 0 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING ORDINANCE NO. 5119 BY AUTHORIZING THE MAYOR TO SIGN A LOCAL AGENCY AGREEMENT SUPPLEMENT BETWEEN THE CITY AND THE WASHINGTON STATE DEPARTMENT OF TRANSPORTATION, APPROVING FEDERAL TEA -21 FUNDS TO PREPARE AND IMPLEMENT THE SOUTH 277T" STREET RECONSTRUCTION PROJECT, PR 562. WHEREAS, the City Council of the City of Auburn must adopt and approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW; and WHEREAS, Ordinance No. 5119 passed July 22, 1998, approved expenditure and appropriation of $4,000,000 in Federal TEA -21 funds with local matching funds of $1,000,000 from the King County/Port of Seattle Interlocal Agreement, and authorized the Mayor and City Clerk to execute a Local Agency Agreement between the State and Washington State Department of Transportation in the amount of $1,982,800, and further authorized the Mayor to execute any future supplemental agreements required for obligation of the remainder of the $4,000,000; and WHEREAS, in the Federal Fiscal Year 2000 allocation was revised to $4,038,462 which is an increase of $38,462 of federal funding for the project; and Ordinance No. 5507 January 22, 2001 Page 1 WHEREAS, the existing Local Agency Agreement must be supplemented to obligate this additional funding. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Purpose. Auburn City Ordinance No. 5119, passed July 22, 1998, is hereby amended to reflect acceptance of $38,462 in Federal TEA - 21 funds and hereby authorizes the Mayor and City Clerk to execute the Local Agency Supplemental Agreement between the City and the Washington State Department of Transportation, a copy of said Supplemental Agreement is attached hereto as Exhibit "A" and is incorporated herein by reference. The Mayor and City Clerk are hereby authorized to approve and execute any future supplemental agreements thereto required for completion of phases of the project, including but not limited to design, right-of-way, and construction and limited to the total amount of $4,038,462. Section 2. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other Ordinance No. 5507 January 22, 2001 Page 2 persons or circumstances. Section 3. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 4. Effective date. This ordinance shall take effect and be in force five (5) days from and after its passage, approval, and publication, as provided by law.
