Assessor's Property Tax Parcel/Account Number: 534360-0010 ❑ Assessor Tax # not yet assigned ORDINANCE NO. 5 6 2 8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING .57 ACRES OF PROPERTY LOCATED AT 2709 AUBURN WAY NORTH WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION FROM C-3 (HEAVY COMMERCIAL) TO M-2 (HEAVY INDUSTRIAL). WHEREAS, Application No. REZ01-0007 dated September 20, 2001, has been submitted to the City of Auburn, Washington, by Armstrong Construction, requesting the rezoning of the.57 acre parcel of land AT 2709 Auburn Way North from C-3 (HEAVY COMMERCIAL) to M-2 (HEAVY INDUSTRIAL) and hereinafter described below and as identified on Exhibit "A" y CD attached hereto and incorporated in this Ordinance by this reference; and a a' WHEREAS, said request above referred to the Hearing Examiner for C=> study and public hearing thereon; and CIN WHEREAS, the Hearing Examiner, based upon staff review, held a h public hearing to consider the request in the Council Chambers of Auburn City Hall on December 18, 2001, at the conclusion of which the Hearing Examiner recommended the approval of the rezoning of said property; and WHEREAS, the City Council, on January 7, 2002, considered said request and affirmed the Hearing Examiner's recommendation for rezone Ordinance 5628 January 7, 2002 Page 1 based upon the following Findings of Fact and Conclusions of Law and Decision. to -wit: FINDINGS OF FACT 1. Armstrong Construction has applied for a rezone to have a portion of their property that is located at 2709 Auburn Way North be rezoned from the existing zoning classification of C-3, Heavy Commercial, to an M-2, Heavy Industrial zone. The property is .57 acres in size. 2. The property that is currently owned by Armstrong Construction is split by two zoning districts, the M-2 and C-3 zone. The common boundary of the two zones also runs through an existing building as well as it will run through the middle of another building that is proposed for construction. The uses of the existing building and the uses for the proposed building are more conducive for M-2 zoning. 3. Therefore, it is proposed to move the M-2 zone boundary approximately 126 feet east to an existing property line which would result in the zoning o boundary being consistent with the property line as well as the zoning o boundary would not run through the existing and proposed buildings. 0 00 4. The Comprehensive Plan Map does illustrate the area of the subject m rezone as Heavy Industrial which would be appropriate for the M-2 zone. 0 0 5. The contents of the case file #REZ01-0007 and the environmental file N #SEP01-0038 of this project are hereby incorporated by reference and made part of the record of this hearing. CONCLUSIONS OF LAW The undersigned has concluded that the rezone may be approved in that the proposal is consistent with the Comprehensive Plan Map designations, zoning and existing uses in the area. Ordinance 5628 January 10, 2002 Page 2 DECISION For each of the above reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this rezone application is approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Purpose. The above-cited Hearing Examiner's Findings of Fact, Conclusions of Law and Decision, are herewith incorporated in this Ordinance. Section 2. The following property located at 2709 Auburn Way North and identified on Exhibit "A" attached hereto and incorporated in this Ordinance by this reference, in the City of Auburn, County of King, State of Washington, c be and the same is hereby rezoned from C-3 (HEAVY COMMERCIAL) to M-2, U 0 00 (HEAVY INDUSTRIAL) C= Section 3. Severability. The provisions of this ordinance are declared cto be separate and severable. The invalidity of any clause, sentence, N paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 4. Recording. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall Ordinance 5628 January 10, 2002 Page 3 cause this Ordinance to be recorded in the office of the King County Auditor, Division of Records and Elections. Section 5. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 6. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
