WHEREAS, at the regular meeting of the Auburn City Council held on January 7, 2102, the Auburn City Council approved the Final Plat of Lakeland Division No. 12, Phase 2, Application No. PLT99-0003, based on the following: FINDINGS OF FACT N 0 1. Henderson Homes has requested final plat approval of the Lakeland o Division No. 12 Phase 2 subdivision and all applicable conditions have m been met. This is a 3 lot single-family subdivision that is located in Lakeland Hills on 515' Street. The preliminary plat was approved by the z City Council in 2000 via Resolution 3202. 0 0 2. The final plat is in compliance with the Zoning and Land Division N Ordinance and is consistent with the City's engineering standards. The required public improvements have been completed in accordance with the Land Division Ordinance and the City of Auburn's standards and specifications. The City Engineer signed the Certificate of Improvements on December 13, 2001. CONCLUSIONS OF LAW 1. The Final Plat is in compliance and in conformity with applicable Zoning and Land Division Ordinances and other applicable land use controls. Ordinance 5629 January 15, 2002 Page 1 3. The Plat meets the requirements of Chapter 58.17 RCW. Based on the foregoing Findings of Fact and Conclusions, the final plat is hereby approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Purpose. Lakeland Division No. 12, Phase 2, is a 3 lot single-family subdivision located on the Lakeland Hills on 515 Street. within the City of Auburn, King County, Washington, which Plat is on file with the City Clerk of the City of Auburn, and which plat is legally described on the face of the Final Plat and setforth in Exhibit "A", is attached hereto and incorporated herein by this reference. N Section 2. Pursuant to RCW 58.17.170, the final plat conforms to all terms of Cn 0 o the preliminary plat approval and complies with all requirements of Chapter 58.17 RCW w and applicable state and local laws. 0 Section 3. Constitutionality or Invalidity. If any section, subsection clause 0 coy or phase of this Ordinance is for any reason held to be invalid or unconstitutional such invalidity unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it is being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed adopted and approved and ratified irrespective of the Ordinance 5629 January 15, 2002 Page 2 fact that nay one or more section, subsection, sentence, clause or phase be declared invalid or unconstitutional. Section 4. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor. Section 5. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 6. Effective Date. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
