HomeMy WebLinkAbout5634 ORDINANCE NO.5 6 3 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, EXTENDING THE EFFECTIVE PERIOD OF THE MORATORIUM ESTABLISHED BY ORDINANCE NO. 5571 ON THE FILING OF BUILDING AND GRADING PERMIT APPLICATIONS IN THE DRAINAGE AREA BOUNDED BY SR-18 TO THE SOUTH, 15TH S1. NW TO THE NORTH, UNION PACIFIC RAILROAD TO THE EAST, SR-167 TO THE WEST AS DEFINED WITHIN THIS ORDINANCE FOR A PERIOD OF SIX MONTHS. WHEREAS, Ordinance No. 5518, adopted by Auburn City Council on February 20, 2001, established a moratorium on the filing of building and grading permit applications in the drainage area bounded by SR-18 to the south, 15th ST NW to the north, Union Pacific Railroad to the east, SR-167 to the west within the City of Auburn; and WHEREAS, the term of the moratorium established by Ordinance 5518 was six months, and WHEREAS, Ordinance 5571 approved August 6, 2001 extended the moratorium for six months; and WHEREAS, studies are currently underway to determine the cause(s) of storm water drainage problems in the area and possible solutions; and WHEREAS, staff has determined that more time is needed to study the issue and determine the feasibility for permitting new development and the specific conditions necessary to address storm drainage issues; and -------------------------- Ordinance No. 5634 February 4, 2002 Page 1 WHEREAS, a public hearing was conducted before the Auburn City Council on February 4, 2002; and WHEREAS, as the study continues, it is becoming apparent that a cost effective solution may not exist; and WHEREAS, after the hearing public, it was determined by the Auburn City Council that extension of the moratorium is necessary to protect the public safety, health, and general welfare. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. EXTENSION OF EFFECTIVE PERIOD OF MORATORIUM. The moratorium established by Ordinance No. 5518, and extended for a period of six months by Ordinance 5571 is hereby extended for an additional six months upon adoption of this Ordinance; provided that the Moratorium, and its continuation status shall be reviewed by the City Council within two months of the date of the adoption of this Ordinance, and further provided that the City Council, in its review of the Moratorium, shall consider alternatives and options that may be added to the Moratorium or applicable development regulations that would limit the scope of the Moratorium or accommodate its earlier termination. Section 2. SEVERABILITY. Should any section, paragraph, sentence, clause or phrase of this Ordinance, or its application to any person or -- ------ ----- ---- --------- Ordinance No. 5634 February 4, 2002 Page 2 circumstance, be declared unconstitutional or invalid for any reason, or should any portion of this Ordinance be pre-empted by state or federal law or regulation, such decision or pre-emption shall not affect the validity of the remaining portions of this Ordinance or its application to other persons or circumstances. Section 3. EFFECTIVE DATE. This Ordinance shall take effect and be in force five days from and after the passage, approved and publication as provided by law.
