Property Tax Parcel/Account Number 05-9045 Assessor Tax # not ORDINANCE NO. 5 6 4 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY LOCATED WEST OF THE INTERSECTION OF 100TH AVENUE SE AND SE 304TH PLACE BETWEEN GREEN RIVER ROAD AND 100TH AVENUE SE, CHANGING THE ZONING CLASSIFICATION FROM LHR -1 (SINGLE FAMILY RESIDENTIAL) TO LHR -2 (SINGLE FAMILY RESIDENTIAL). WHEREAS, Application No. REZ00-0007 dated October 25, 2000, has been submitted to the City of Auburn, Washington, by Wayne Jones, requesting the rezoning of the parcel of land at located on the north side of the Green River Road near its intersection with 100`h Avenue SE from LHR -1 cr) (SINGLE FAMILY RESIDENTIAL)to LHR -2 (SINGLE FAMILY RESIDENTIAL) CM and hereinafter described below and as identified on Exhibit "A" attached a hereto and incorporated in this Ordinance by this reference; and © WHEREAS, said request above referred to the Hearing Examiner for 0 study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider the request in the Council Chambers of Auburn City Hall on February 20, 2002, at the conclusion of which the Hearing Examiner recommended the approval of the rezoning of said property; and Ordinance 5636 February 11, 2002 Page 1 WHEREAS, the City Council, on March 4, 2002, considered said request and affirmed the Hearing Examiner's recommendation for rezone based upon the following Findings of Fact and Conclusions of Law and Decision, to -wit: FINDINGS OF FACT Wayne Jones has applied for a rezone to have the zoning on his property, located on the north side of the Green River Road near its intersection with 100th Avenue SE, changed from the existing LHR -1 zoning to a proposed LHR -2 zoning. The main difference between the LHR -1 and LHR -2 zones is that the LHR -1 zone requires an 8,000 square foot lot and the LHR -2 zone requires a 6,000 square foot lot. The property is 3.58 acres in size and is currently vacant. 2. In addition to the rezone there are a number of other applications that are being processed concurrent with the rezone. A preliminary plat approval for an 18 -lot single family subdivision is being processed. A shorelines management permit is required since a portion of the project falls within the shorelines of the Green River. There are also two variances to the Zoning �. Code standards being proposed. One variance would allow for the orientation of the setbacks for lot 10 to be modified and the other variance m would allow for a five-foot reduction in the rear yard setbacks for lots 1-10. G O 3. The purpose of the rezone would allow for more flexibility in the design and layout of the subdivision since the LHR -2 zone allows for a smaller lot size o and smaller lot dimensions than the LHR -1 zoning district. The proposed c.. LHR -2 zone would allow for approximately 2-3 more lots on the subject C= property than would the existing LHR -1 zone. CONCLUSIONS OF LAW The undersigned has concluded that the rezone may be approved in that the proposal is consistent with the Comprehensive Plan Map designations, zoning and existing uses in the area. DECISION Ordinance 5643 March 7, 2002 Page 2 For each of the above reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this rezone application is approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Purpose. The above-cited Hearing Examiner's Findings of Fact, Conclusions of Law and Decision, are herewith incorporated in this Ordinance. Section 2. The following property located on the north side of the Green River Road near its intersection with 100`h Avenue SE, and identified on Exhibit "A" attached hereto and incorporated in this Ordinance by this reference, in the City of Auburn, County of King, State of Washington, be and ti the same is hereby rezoned from LHR -1 (SINGLE FAMILY RESIDENTIAL) to LHR -2 (SINGLE FAMILY RESIDENTIAL). c Section 3. Severability. The provisions of this ordinance are declared C= to be separate and severable. The invalidity of any clause, sentence, CZ paragraph, subdivision, section or portion of this ordinance, or the invalidity of cQ the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 4. Recording. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall Ordinance 5643 March 7, 2002 Page 3 cause this Ordinance to be recorded in the office of the King County Auditor, Division of Records and Elections. Section 5. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 6. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
