AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, TO AMEND
ORDINANCE NUMBER 5190, AS AMENDED BY ORDINANCE NUMBER
5459, WHICH APPROPRIATED COMMUNITY DEVELOPMENT BLOCK
GRANT (CDBG) FUNDS IN 1999, AND ORDINANCE NUMBER 5311, AS
AMENDED BY ORDINANCE NUMBER 5459, WHICH APPROPRIATED CDBG
FUNDS IN 2000, AND ORDINANCE NUMBER 5459, WHICH
APPROPRIATED CDBG FUNDS IN 2001, TO RELEASE CERTAIN UNUSED
CDBG FUNDS IN ORDER TO REAPPROPRIATE SUCH FUNDS FOR USE
DURING THE 2002 CDBG PROGRAM YEAR IN ADDITION TO THE CITY'S
ENTITLEMENT FUNDS; AND TO APPROPRIATE A TOTAL AMOUNT OF
FOUR HUNDRED FORTY-SIX THOUSAND FIVE HUNDRED AND NINETY-
ONE DOLLARS ($446,591) FOR THE 2002 PROGRAM YEAR; AND TO
AUTHORIZE THE MAYOR TO IMPLEMENT THE APPROVED PROGRAMS
AND PROJECTS.
WHEREAS, the City Council of the City of Auburn must adopt and
approve all appropriations by ordinance pursuant to Chapter 35A RCW; and
WHEREAS, the City is an entitlement applicant for Community
Development Block Grant (CDBG) funds under the Housing and Community
Development Act of 1974 (the Act), Pub. L. 93-383 as amended, and will
receive CDBG funds for the purpose of carrying out eligible community
development and housing activities under the Act and under regulations
promulgated by the Department of Housing and Urban Development (HUD) at
24 CFR Part 570; and

WHEREAS, according to RCW 35A.33.150 special fund appropriations
do not lapse but carry forward from year to year until fully expended or the
purpose has been accomplished or abandoned without necessity of
reappropriation; and
WHEREAS, it is in the best interest of the City of Auburn and its citizens
to amend Ordinances Numbered 5190, 5311, and 5459 to release certain
unused specified funds appropriated therein and to reappropriate those funds
for the 2002 Program Year in order to address current needs; and
WHEREAS, the City desires to award certain funds for use as described
within this Ordinance, for the purpose of implementing eligible activities under
the Act and HUD regulations; and
WHEREAS, the Legislature has declared that carrying out the purposes
of federal grants or programs is both a public purpose and an appropriate
function for a city, town, county, or public corporation;
NOW THEREFORE THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO HEREBY ORDAIN THE FOLLOWING:
SECTION1. Purpose. Amendment to Ordinance No. 5190 as
amended by Ordinance No. 5459 to reallocate a total of Thirteen Thousand,

Four Hundred and Forty-One Dollars, Fifty-Five Cents ($13,441.55) to the 2002
Program Year.
Ordinance No. 5190, approved by the Auburn City Council on
December 7, 1998 and amended by Ordinance No. 5459 on
November 6, 2000, is hereby amended to release funds in the
amount of Seven Thousand Four Hundred Sixty-Six Dollars,
Sixty-Six Cents ($7,466.66) which was allocated to Auburn Youth
Resources for facility improvements; and to release funds in the
amount of Five Thousand Nine Hundred Seventy-Four Dollars,
Eighty-Six Cents ($5,974.86) which was allocated to Habitat for
Humanity of South King County for Property Acquisition; as
provided for in "Exhibit A," which was incorporated by reference
into Ordinance No. 5190. "Exhibit A" of Ordinance No. 5190
provides:
Auburn Youth Resources, Building Renovations $ 39,000
Funds will be used to renovate and remodel AYR's present
building, to provide confidentiality for clients and improve
accessibility to and outside the building. {CDBG eligible under
24CFR 570.201(c)}
Habitat for Humanity of South Kinq County $ 401000
Acquisition of site in Auburn for construction of home that will
be sold at no profit, no interest, to a Iow-income family, sing
volunteer labor and the homeowners' "sweat equity." {CDBG
eligible under 24CFR 570.201(a)}
The funding was not completely used, creating the necessity
for reappropriation and reallocation of the balance of funds for
use in the 2002 CDBG Program Year.
SECTION 2. Amendment to Ordinance No. 5311 as amended by
Ordinance No. 5459 to reallocate a total of Eighteen Thousand One Hundred
Forty-Nine Dollars, Three Cents ($18,149.03) to the 2002 Program Year.

Ordinance No. 5311 approved by the Auburn City Council on
November 1, 1999, and amended by Ordinance No. 5459 on
November 6, 2000, is hereby amended to release funds in the
amounts of Nine Hundred Six Dollars, Seventeen Cents ($906.17)
which was allocated to Auburn Youth Resources for Roofing
Repairs; and to release funds in the amount of Seventeen
Thousand Two Hundred Forty-Two Dollars, Eighty-Six Cents
($17,242.86) which was allocated to the Department of Planning
and Community Development for CDBG Administration; as
provided in Exhibit "A," which was incorporated by reference in
Ordinance No. 5311. "Exhibit A" of Ordinance No. 5311 provides:
Auburn Youth Resources, Roof Replacement: $19,928
Funds will be used to replace the roofs and make necessary
repairs to AYR's facilities - counseling offices, South King
Youth Shelter, and Severson House. {CDBG eligible under

Program Administration $601000
Salary, benefits and program materials necessary to
implement, monitor and administer eligible CDBG activities.

The funding was not completely used, creating the necessity
for reappropriation and reallocation of the balance of funds for
use in the 2002 CDBG Program Year.
SECTION 3. Amendment to Ordinance No. 5459 to reallocate a total of
Eight Thousand Dollars ($8,000) to the 2002 Program Year.
Ordinance No. 5459, approved by the Auburn City Council on
November 6, 2000, is hereby amended to release funds in the
amount of Eight Thousand Dollars ($8,000) which was allocated
to the Department of Planning and Community Development for
CDBG Administration; as provided in Exhibit "A," which was
incorporated by reference in Ordinance No. 5459. "Exhibit A' of
Ordinance No. 5459 provides:

reappropriation and reallocation of the balance of funds for use in
the 2002 CDBG Program Year.
SECTION 4. CDBG Budget for 2002 Program Year.
The City Council of the City of Auburn hereby approves the
reappropriation of the amounts provided in Sections I through 3 hereof and
combines these aforementioned amounts, totaling Thirty-Nine Thousand Five
Hundred Ninety Dollars, Fifty-Eight Cents ($39,590.58) into the City of
Auburn's 2002 CDBG entitlement of Four Hundred Seven Thousand Dollars
($407,000), for a combined 2002 CDBG program budget of Four Hundred
Forty-Six Thousand Five Hundred Ninety Dollars, Fifty-Eight Cents
($446,590.58) for programs, projects, and administrative costs recommended
by the Human Service Committee and approved by the Planning and
Community Development Committee for the 2002 CDBG Program Year.
Specific expenditures for the 2002 Program Year are itemized in Exhibit "A,"
attached hereto and incorporated herein by this reference. Disbursement of
CDBG funds for a specific program or project shall not exceed the amount

appropriated, as indicated on the itemized budget set forth in Exhibit "A," to
this Ordinance No. 5630 for that particular program or project.
SECTION 5. Prerequisites for Use of CDBG Funds.
Grant recipients must certify that their planned use of CDBG funds
complies with the following:
(a) Compliance with national objectives.
Grant recipients must certify that their use of CDBG funds
gives maximum feasible priority to activities that benefit Iow
and moderate income residents or aid in the prevention or
elimination of sums or blight.
(b) Compliance with environmental review procedures.
Grant recipients must certify their compliance with
environmental review procedures set forth in 24 CFR, part
58, for each activity as applicable.
SECTION 6. Limitations on Expenditures and Adjustments.
No appropriation shall be made in excess of actual revenues and no
liability is to be incurred in excess of appropriations. In the event that actual
revenues are different than the revenues estimated by the CDBG budget, the
following actions shall be taken:
(a) Public Service Programs:
In the event the City receives a different amount of funding
than its budgeted CDBG entitlement, each appropriation for
public services will receive a proportionately equal reduction

(increase) in its appropriation relative to the total decrease
(increase) in total revenues.
(b) Capital-Funds Programs:
Appropriations for capital projects, including the Housing
Repair Program, shall be released only when actual revenues
are sufficient to fully fund the appropriation unless both the
recipient Agency and the City mutually agree to a partial
funding of the Agency's original appropriation. Partial funding
of an appropriation will release the City from further obligations
to fund that particular appropriation and, thereby, allow the
City to consider funding either all or part of another
appropriation.
In the event that the City receives more than its budgeted
CDBG entitlement, the non-budgeted portion of the
appropriation not available for public service activities will be
provided to the Housing Repair Program.
Funds budgeted to capital projects which are reduced in cost,
thus returning funds to the CDBG program during the Program
Year, will be reallocated to the Housing Repair Program.
SECTION 7. Implementation.
The Mayor is hereby authorized to implement such administrative
procedures as may be necessary to carry out the directives of this legislation.

SECTION 8, Severability.
The provisions of this ordinance are declared to be separate and
severable. The invalidity of any clause, sentence, paragraph, subdivision,
section or portion of this ordinance, or the invalidity of the application thereof to
any person or cimumstance shall not affect the validity of the remainder of this
ordinance, or the validity of its application to other persons or circumstances.
SECTION 9. Effective Date:
This Ordinance shall be in force and take effect five (5) days from and
after its passage, approval and publication, as provided by law.

NEIGHBORHOOD REVITALIZATION

Grants of less than $4,000 and/or loans of less than $10,000 for necessary repairs and
renovation o£ single family homes owned and occupied by low and moderate income
households at various locations throughout Auburn. {CDBG eligible under
24CFR570.202}
Low Income Housing Institute - JC Penney Rehabilitation $130,000
Funds to be used for acquisition of vacant JC Penney building, for subsequent
rehabilitation into 24 units of housing and ground-floor commercial space. {CDBG
eligible under 24CFR570.208(a)(c)}
HOMELESS/SPECIAL NEEDS FACILITIES
Valley Cities Counseling and Consultation $50,000
Funds to be used for the purchase and installation of communications system at new
