HomeMy WebLinkAbout5739ORDINANCE NO. 5 7 3 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, CREATING A NEW CHAPTER 5.05 OF THE AUBURN CITY CODE RELATING TO ACCESS TO INFORMATION FOR BUSINESS LICENSES AND REGISTRATIONS WHEREAS, the City of Auburn regulates certain activities, including registration; and WHEREAS, in connection has codes that define parameters and those involving business licensing and with the business licensing and registration provisions of the City code, certain information is occasionally needed by the City to evaluate compliance with code provisions and to enforce violations of the business licensing and registration code requirements; and WHEREAS, in order to assure the City of convenient access to this information, it is appropriate to include in the City code previsions making access to such information a condition on which business licenses or registrations shall be granted. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section '1. New Section. A new Section 5.05 of the Auburn City code is hereby created to read as follows: Ordinance 5739 January 29, 2003 Page 1 I I Section: 5.05.010 Chapter 5.05 ACCESS TO INFORMATION Authorization for access to information 5.05.0'10 Authorization for access to information A. As a condition for the issuance of any business license or registration under this title, the City shall be authorized to receive information involving the business and/or information pertinent to the City's interest therein, from the business licensee or permittee or any other source from which the information would reasonably be available, directly or indirectly. B. Any failure to comply with the request for information reasonably requested by the City, or refusal to allow access to such information shall be a basis for revocation or suspension of the business license or registration, in accordance with the appropriate provisions under this title. Section 2. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 3. Constitutionality. If any section, subsection, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it is being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed adopted and approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional.
