HomeMy WebLinkAbout5915 ORDINANCE NO. 5 9 1 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, CREATING A NEW SECTION 10.12.125 OF THE AUBURN CITY CODE RELATING TO THE SPEED LIMIT IN SCHOOL ZONES - WHEN CHILDREN PRESENT OR LIGHTS FLASHING WHEREAS, among the responsibilities that fall upon the City are those dealing with traffic safety, particularly, the safety of children in the vicinity of schools and in school zone traffic corridors; WHEREAS, in order to address the responsibilities regarding enforcement of school zone speed limits, there are options that are available to the City, including indicating specific times when the school zone speed limits apply or other limitations that exist with respect to the enforcement of such speed limits; and WHEREAS, a tool that has been available in this state through various channels has been the regulation of school zone speed limits based upon the presence of children; and WHEREAS, in order to utilize this tool, it is, however, appropriate to define its meaning so that there is not confusion to the public and there is clarity in terms of the intended enforcement. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: ~------~~------------------- Ordinance 5915 May 16, 2005 Page 1 Section 1. That a new section 1 0.12.125 of the Auburn City Code (ACC) is created to read as follows: 10.12.125 Speed limit in school zones - when children present or when lights flashing. Notwithstanding the speed limit that would otherwise apply on a city street, road or other right-of-way, the speed limit in posted school zones is 20 miles per hour when lights have been installed in conjunction with any school zone sign and such lights are flashing or when children are present. Signage shall be installed at appropriate locations, as determined by the city engineer stating "School Zone - 20 mph when flashing or when children are present, per ACC 10.12.125" or words to that effect. For the purposes hereof, ''when children are present" means: (1) Children are occupying or walking within the marked crosswalk in a posted school zone; (2) Children are occupying or waiting at the curb or on the shoulder of the roadway in a posted school zone and are about to cross the roadway by way of the marked crosswalk, or (3) Children are present on or walking along the roadway, either on the adjacent sidewalk or, in the absence of sidewalks, on the shoulder within the posted school speed limit zone, which extends three hundred feet in either direction from the marked crosswalk. Section 2. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 3. Severabilitv. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. ---------------------------- Ordinance 5915 May 16, 2005 Page 2 Section 4. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
