ORDINANCE NO.5 9 8 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, ANNEXING PROPERTY LOCATED ON THE SOUTH SIDE OF MOUNTAIN VIEW DRIVE INTO THE CITY FOR MUNICIPAL PURPOSES WHEREAS, pursuant to Section 35A.14.300 of the Revised Code of Washington (RCW), legislative bodies of code cities may by a majority vote annex territory outside the limits of such city, whether contiguous or not contiguous for any municipal purpose when such territory is owned by the city; and, WHEREAS, the City of Auburn owns property located on the south side of Mountain View Drive, for which it has a municipal purposes, to wit: for parks and recreation and/or open spaces; and, WHEREAS, in accordance with RCW 35A.14.300, the City Council desires to annex said territory into the City of Auburn. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. The City of Auburn owns property located south side of Mountain View Drive, legally described as follows: SITUATE IN THE SOUTHWEST QUARTER OF SECTION 14 TOWNSHIP 21 NORTH RANGE 4 E.W.M. KING COUNTY WASHINGTON, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING ON A POINT ON THE AUBURN CITY LIMITS AS ESTABLISHED BY AUBURN ORDINANCE #3242 SAID POINT BEING THE INTERSECTION OF THE NORTH RIGHT OF WAY LINE OF MT. VIEW DRIVE (AKA S.331sT) WITH THE EAST LINE Ordinance No. 5981 January 3, 2006 Page 1 OF THE SOUTHWEST QUARTER OF SECTION 14 TOWNSHIP 21 NORTH RANGE 4 E.W.M.; THENCE SOUTH ALONG SAID EAST LINE OF SW 14-21-04 TO THE NORTH RIGHT OF WAY LINE OF STATE ROUTE 18 (AKA P.S.H. NO.2); THENCE IN A WESTERLY DIRECTION FOLLOWING THE NORTH RIGHT OF WAY LINE OF SAID STATE ROUTE 18 TO THE SOUTHWEST CORNER OF LOT 76 OF THE WEST FIVE ACRE TRACTS AS RECORDED IN VOLUME 15 PAGE 12 OF RECORDS OF KING COUNTY WASHINGTON; THENCE NORTH ALONG THE WEST LINE OF SAID LOT 76 TO THE SOUTH RIGHT OF WAY LINE OF SAID S.331sT; THENCE EASTERLY ALONG THE SOUTH RIGHT OF WAY LINE OF SAID S.331sT TO THE NORTHWEST CORNER OF LOT 74 OF SAID WEST FIVE ACRE TRACTS; THENCE EASTERLY ALONG THE SOUTH LINE OF SAID S. 331sT A DISTANCE OF 30 FEET; THENCE NORTH ALONG A LINE THAT IS PARALLEL WITH THE WEST LINE OF THE EAST ONE HALF OF THE EAST ONE HALF OF SAID QUARTER SECTION TO THE SAID AUBURN CITY LIMITS; THENCE EAST ALONG SAID CITY LIMITS TO THE POINT OF BEGINNING. Section 2. The City Council finds that said property should be used for municipal purposes, to wit: for parks and recreation and/or open spaces. Section 3. That the City Council hereby annexes said property into the City of Auburn pursuant to the authority of RCW 35A.14.300. Section 4. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Ordinance No. 5981 January 3, 2006 Page 2 Section 6. Effective date.
