ORDINANCE NO.5 9 8 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, ANNEXING PROPERTY ON THE NORTHWEST CORNER OF THE INTERSECTION OF SOUTH 320TH AND 124TH AVENUE EAST INTO THE CITY FOR MUNICIPAL PURPOSES WHEREAS, pursuant to Section 35A.14.300 of the Revised Code of Washington (RCW), legislative bodies of code cities may by a majority vote annex territory outside the limits of such city, whether contiguous or not contiguous for any municipal purpose when such territory is owned by the city; and, WHEREAS, the City of Auburn owns property located on the northwest corner of the intersection of South 320th and 124th Avenue East, for which it has a municipal purposes, to wit: for parks and recreation and/or open spaces; and, WHEREAS, in accordance with RCW 35A.14.300, the City Council desires to annex said territory into the City of Auburn. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. The City of Auburn owns property located on the northwest corner of the intersection of South 320th and 124th Avenue East, legally described as follows: SITUATE IN THE SOUTHWEST QUARTER OF SECTION 9, TOWNSHIP 21 NORTH, RANGE 5 E.W.M. OF KING COUNTY WASHINGTON AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: Ordinance No. 5983 January 3, 2006 Page 1 THE SOUTH 1/2 OF THE SOUTHEAST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 9 TOWNSHIP 21 NORTH RANGE 5 E.W.M. LESS COUNTY ROADS AND LESS THAT PORTION LYING WESTERLY OF THE FOLLOWING DESCRIBED LINE; BEGINNING AT THE INTERSECTION OF THE NORTH MARGIN OF THE SE 320TH ST RIGHT OF WAY & THE EAST MARGIN OF THE PLAT OF LEA HILL VILLAGE DIV #1 AS RECORDED IN VOLUME 87 PAGES 39 AND 41, RECORDS OF KING COUNTY WASHINGTON; THENCE NORTHERLY ALONG EASTERLY MARGIN OF 122ND AVE SE TO THE NORTHEAST MARGIN OF SE 319TH PLACE; THENCE N 03-01-75 E 75 FT ; THENCE S 88-45-00 E 92 FT; THENCE N 01-10-00 W 178.84 FT; THENCE N 86-44-10 W TO THE SOUTHEAST CORNER OF LOT 75 OF LEA HILL VILLAGE DIV 3-A; THENCE NORTH ALONG EASTERLY MARGIN OF SAID PLAT OF LEA HILL VILLAGE DIVISION 3-A TO THE NORTH LINE SAID SOUTH 1/2 OF THE SOUTHEAST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 9 TOWNSHIP 21 NORTH RANGE 5. Section 2. The City Council finds that said property should be used for municipal purposes, to wit: for parks and recreation and/or open spaces. Section 3. That the City Council hereby annexes said property into the City of Auburn pursuant to the authority of RCW 35A.14.300. Section 4. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
