Assessor Tax # not 7002200390, 7002200330, 7002200270, 7002200040, 7002200100, 7002200160, 7002200220, 7002200560, 7002200470, 7002200480, 7002200380, 7002200320, 7002200260, 7002200050, 7002200110, 7002200170, 7002200230, 7002200580, 7002200550, 7002200510, 7002200500 ORDINANCE NO. 6 0 8 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, APPROVING THE FINAL PLAT OF TERRACE VIEW TOWNHOMES, INCLUDING AND PROVIDING FOR A RIGHT OF WAY USE APPLICATION APPROVAL, THE RELINQUISHMENT OF EASEMENTS AND THE AUTHORIZATION OF A QUIT CLAIM DEED RELATED THERETO WHEREAS, the City of Auburn received a final plat application for the Plat of Terrace View Townhomes, Application No. PLT06-0007, the final approval of which is appropriate for City Council Action; and WHEREAS, the plat property is currently encumbered by a water booster pump station tract and various utility easements that are no longer necessary in their current locations due to the platting of the property; and WHEREAS, based on the review given this Plat by the City, the City Council hereby makes and enters the following: FINDINGS OF FACT 1. Terrace View Properties, LLC, represented by Prizm Surveying and Pacific Engineering Design, LLC, has requested final plat approval of Terrace View Townhomes and all applicable conditions have been met. 2. The preliminary plat was approved by the City Council on March 16, 2006, by Resolution No. 4009. The plat has been developed in accordance with the TV, Terrace View zone district. 3. Subsequent to preliminary plat approval, the developers requested administrative approval of a minor adjustment to the plat to create a new open space tract and extend an established tract, in addition to minor lot line changes. The Planning Director approved the minor adjustment pursuant to ACC 17.06.100.A. 4. The Final Plat is in compliance with the Zoning and Land Division Ordinances and is consistent with the City's engineering standards. ---------------- Ordinance No. 6087 May 1, 2007 Page 1 of 4 5. A Certificate of Improvements has been issued by the City Engineer, accepting all required plat improvements. 6. The City of Auburn has previously obtained a site within the plat for the purposes of constructing a water booster pump station. The plat will relocate this site to another location (Tract D) and provide for its dedication. It is therefore necessary for the City to issue a Quit Claim Deed for the existing water booster pump station site. 7. A sanitary sewer lift station current exists within an easement on a portion of the plat and several other sewer and water easements exist on the property. The plat will provide for the dedication of public right-of-ways in which plat utilities will be located. Therefore, it is necessary for the City to relinquish these easements. 8. The plat needs to relocate an existing private clean storm water line servicing the Belara Apartments located to the east and uphill of the property. Portions of this line are proposed for location within public right- of-way. Therefore, approval of a Right of Way Use Permit is required. CONCLUSIONS OF LAW 1. The Final Plat is in compliance and in conformity with applicable Zoning and Land Division Ordinances and other applicable land use controls. 2. The Plat is consistent with the Comprehensive Plan. 3. The Plat meets the requirements of Chapter 58.17 RCW. 4. The City of Auburn may quit claim its interest in the existing water booster pump station deeded to the City under Pierce County Auditors Fee No. 2000103295016 in favor of the dedication of Tract D of the plat for this same purpose. 5. The City of Auburn may approve Right of Way Use Permit Application No. 07-11 to allow for the location of a clean water storm drainage line within Terrace View Drive SE and across proposed Alexander Dr. SE. 6. The City of Auburn may relinquish various sanitary and water utility easements recorded under Pierce County Auditor Fee Nos. 200209160499, 200305211187 and 200305211188 in favor of the public right of ways being dedicated with this plat. ---------------- Ordinance No. 6087 May 1, 2007 Page 2 of 4 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. Approval. Terrace View Townhomes, a subdivision involving property located within the City of Auburn, Washington, which plat is legally described on the face of the Final Plat and set forth in Exhibit "A," attached hereto and incorporated herein by reference, is hereby approved, and deemed to conform to the requirements for Plat approval pursuant to State and local law and Chapter 58.17 of the Revised Code of Washington and Section 58.17.140 thereof. Section 2 Constitutionality or Invalidity. If any section, subsection clause or phase of this Ordinance is for any reason held to be invalid or unconstitutional such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it is being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed adopted and approved and ratified irrespective of the fact that nay one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 3. Recordation. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the Pierce County Auditor's Office, Records and Licensing Division. Section 4. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. Effective Date.
