HomeMy WebLinkAbout6094ORDINANCE NO. 6094 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DECLARING PUBLIC USE AND NECESSITY REGARDING CITY OF AUBURN PROJECT NO. C501A, URBAN CENTER TRANSPORTATION IMPROVEMENTS, AND AUTHORIZING CONDEMNATION WHEREAS, the City of Auburn is involved in Project No. C501A, Urban Center Transportation Improvements (the Project); and WHEREAS, the Project includes improvements to the intersection of Auburn Avenue NW and First Street NW; and WHEREAS, a portion of the property located at 103 Auburn Avenue NW is necessary for those intersection improvements (the Intersection Area); and WHEREAS, the City is engaged in ongoing negotiations with Universal Health Services, the owner of the property, to obtain the Intersection Area; and WHEREAS, passage of this Ordinance will allow the City to begin the condemnation process, insuring that the Project can be constructed in a timely manner; and WHEREAS, the City will continue to pursue the negotiated purchase of the Intersection Area; and WHEREAS, because of the importance of the Project as part of the City's transportation and infrastructure system, and because the improvements are necessary to complete the project, the Intersection Area is necessary for the Project and for completion of the public uses of the Project. Ordinance No. 6094 April 16, 2007 Page 1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON DO ORDAIN as follows: Section 1. Declaration of Necessity. That the property identified herein is necessary for improvements to the intersection of Auburn Avenue NW and First Street NW, as part of the public use of constructing City of Auburn Project No. C501A, Urban Center Transportation Improvements. Section 2. Authorization for Condemnation. That the Mayor and/or designee(s) is/are authorized to commence condemnation action to acquire the property identified as follows: That certain property generally located at the Northwest Corner of the Intersection of Auburn Avenue NW and First Street NW, in Auburn, Washington, legally described in Exhibit "A" and depicted in Exhibit "A-1," both attached hereto and incorporated by reference. Section 3. Authorization for Administrative Action. That the Mayor and/or designee(s) is/are further authorized to take such other action and/or implement such other administrative procedures as may be necessary to carry out the directives of this legislation. Section 4. Compensation from Arterial Street Fund. That the compensation to be paid to the owners of the property to be acquired by the condemnation action shall be paid from the Arterial Street Fund of the City. Section 5. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application Ordinance No. 6094 April 16, 2007 Page 2 thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 6. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
