<br /> <br /> <br /> <br /> <br /> ORDINANCE NO. 6 2 3 5 <br /> <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> AUBURN, WASHINGTON, AMENDING CHAPTER 16.08 OF <br /> THE AUBURN CITY CODE RELATING TO SHORELINE <br /> MANAGEMENT ADMINISTRATIVE AND PERMITTING <br /> PROCEDURES, AND AMENDING THE ADOPTED AUBURN <br /> SHORELINE MASTER PROGRAM CONSISTENT <br /> THEREWITH <br /> <br /> WHEREAS, in 1971 the Washington State Legislature required that local <br /> jurisdictions, with the aide of the Washington State Department of Ecology, <br /> develop master programs for regulation of the uses of their shorelines; and <br /> <br /> WHEREAS, on January 21, 1974 the City of Auburn adopted a Shoreline <br /> Management Master Program to regulate uses within the city's shorelines; and <br /> <br /> WHEREAS, in 2003 the state legislature established timelines, funding, and <br /> guidelines requiring all cities and counties to update their Shoreline Master <br /> Programs; and <br /> <br /> WHEREAS, the City of Auburn initially began a process to review and <br /> develop an updated Shoreline Master Program in 2005; and <br /> <br /> WHEREAS, a Citizen Advisory Committee (CAC) was formed that included <br /> members of the Auburn Community that met on a regular basis to participate in <br /> developing an updated Shoreline Master Program; and <br /> <br /> WHEREAS, after proper notice published in the City's official newspaper at <br /> least ten (10) days prior to the date of hearing, the City of Auburn Planning <br /> Commission on April 3, 2007 conducted a public hearing on the proposed <br /> Shoreline Master Program Update; and <br /> <br /> WHEREAS, at the public hearing, the City of Auburn Planning Commission <br /> heard public testimony and took evidence and exhibits into consideration; and <br /> <br /> WHEREAS, said exhibits included documents entitled Draft Auburn <br /> Shoreline Master Program, Shoreline Inventory and Characterization Report and <br /> Map Folio, Shoreline Issues of Concern Analysis, Shoreline Restoration Plan and <br /> Cumulative Impacts Analysis completed by the City's consultant in support of the <br /> Updated Shoreline Master Program; and <br /> <br /> WHEREAS, SEPA review (City SEPA file SEP07-0006) was conducted on <br /> the Shoreline Master Program Update with a Determination of Non-Significance <br /> (DNS) issued March 23, 2007, a final DNS issued April 10, 2007 with no appeals <br /> having been filed; and <br /> Ordinance No. 6235 <br /> April 15, 2009 . <br /> Page 1 <br />
