HomeMy WebLinkAbout6290 ORDINANCE NO. 6 2 9 0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING CHAPTER 2.45 OF THE AUBURN CITY CODE RELATING TO THE PLANNING COMMISSION WHEREAS, the current provisions of the Auburn City Code provide for the appointment and membership of a Planning Commission as the City's planning agency; WHEREAS, the current provisions of the City Code vest in the Planning Commission responsibility for evaluating and considering land use, zoning and related development regulations applicable within the City; and WHEREAS, in order to afford a perspective to be included from the youth of the City, it would be valuable to provide for the appointment of an ex-officio, non-voting youth member of the commission. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. Amendment to Citv Code. That Chapter 2.45 of the Auburn City Code be and the same hereby is amended to read as follows: Chapter 2.45 PLANNING COMMISSION' Sections: • 2.45.010 Membership - Term of office. 2.45.020 Removal of inembers. 2.45.010 Membership - Term of office. ~ A. The city planning commission shall consist of seven members to be appointed by the mayor and confirmed by the city council; provided, that the planning ' For statutory provisions on the creation of city planning commissions, see RCW 35.63.020 and 35.63.030; for provisions authorizing code cities to provide by ordinance for a planning agency, see RCW 35A.63.020. Ordinance No. 6290 January 7, 2010 Page 1 of 3 commission membership may be increased to eight members upon the mayor appointing and the city council confirming an eighth member. Members shall serve for a period of six years and expiration shall be designated to provide the fewest possible terms will expire in any one year; provided, that the term of office for any commission members appointed or reappointed after December 1, 2004, shall be three years from the date of appointment or reappointment. The planning commission will have such duties and responsibilities as set forth in Chapter 35A.63 RCW as amended. Copies shall be on file with the city clerk and made available at the public's request, the number in such manner as required by law. B. There is established an ex-officio vouth reqresentative qosition on the planninq commission. This position shall be filled bv the appointment of the mavor of a youth residinq within the citv's municipal limits who is a senior in hiqh school, is in pood scholastic standinq has no criminal record and is nominated bv the superintendent of the Auburn school district from interested students attendinq a public or private hiqh school located within the citv. This position shall be non-votinq, but shall have all riphts and privileqes of a votinp member to participate in all activities and functions of the commission except votes taken to recommend an action to the citv council. A youth representative shall be appointed annually bv the mavor, with the annual period of service to run from June of one year to June of the subsequent vear. Members of the commission shall be subject to removal in accordance with the provisions of Chapter 2.30 ACC as it currently exists or as it may be amended hereafter. Ex-officio vouth representatives of the commission shall also be subiect to removal in accordance with the provisions of Chapter 2.30 ACC as it currentiv exists or as it mav be amended hereafter. (Ord. 5803 § 7, 2003.) Section 2. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 3. Severabilitv. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
